I thought some practical information would be more useful to the OP than a statement of the theoretical position.  What the law says and what is accepted practice based on common sense, practical considerations and what the public will tolerate have always been very different, thank goodness.  The regional authorities have declared that they will not enforce national regulations about mask wearing on beaches, and therefore, in a practical sense, it is not required.

Gordon,  I think you are writing posts about what you would like to happen. 

I'm out and about most days in Benidorm and all police wear masks and 90% of the public wear their masks in a proper manner. 

I imagine that you are one of the 10% who spend a couple of weeks in Finestrat and refuse to abide by the strict rules "because it's your rights"

I don't think that you represent the majority of people in Finestrat.

Wrong again, Gordon.

"Under the newly published law (March 2021), which replaces the June decree, regional governments may no longer introduce changes. Instead, everyone is bound by the same regulations, which make masks mandatory at all times, including at the beach or the local swimming pool, and even when there is a safe distance between people".

The Balaeric Islands' regional government has said it will not enforce the mandatory mask rule on its beaches.  However, Comunidad Valenciana has said it will not be varying the national law, because it's in line with the stricter regulations the Valencian regional government already has in place.

This morning, I went to Torrevieja for a meeting and then had lunch afterwards opposite the marina.  In 2 hours I did not see a single person failing to wear a face mask.  People arrived at restaurants wearing masks and  only removed them while they were eating and drinking.  It was good to see people respecting the law and, in so doing, respecting the rights and safety of others.

Some good, sound advice offered here, including the legal position. My advice would be to try to source a mask that your wife is able to tolerate. What you really don’t want is to be getting into a discussion with others, including the police, to explain why she’s not wearing one.

Yes good advice, heavy fines are implemented for not wearing a mask and as soon as you start to argue with the guardia the fine is doubled.
