Claiming consequential loss

Hi

I have a crane hanging over my house half a metre from the border wall and has been for months. They have demolished a villa and are constructing a new one. We are unable to enjoy life in our property as its far too hazardous to sit outside.  They have damaged our property with deep excavation and our insurance Co are dealing with this. We usually rent our villa out for 6 weeks in the summer and go back to family in the UK however not possible now.  We are pensioners and this helps us cover our yearly expenses. Does anyone know  if we can claim for our loss of earnings?

Sorry to hear all that sad news. I certainly think that is a 100% need to contact a solicitor. .

Hi dazza70,

That sounds awful.  However, unless you have a Tourist Licence for renting out your property during a few summer weeks, you could be opening a can of worms by trying to claim for lost rental income.

I'm not trying to be negative, but I wish anyone living in Spain good luck in trying to claim for ANYTHING.

Best I can say is get a good solicitor with a known track record.

I am currently reaping the 'benefits' of using a local one.

Thanks  l know exactly what you mean. Its very hard to get anywhere with anything legal. My husband had an accident in Condum  someone had spilt slippery liquid on the floor and nobody cleaned it up. He had to go to hospital for xrays coukdntcwork fir 2 weeks shoulder strapped up and the supermarket did nothing to help.. they helped hom up admitted what had happened then 2 weeks later denied it and said the inshore cameras were not eorking on that area.  Totally  dishonest and uncaring. Its just a different mentality here, they just don't care.

Dazza70, sadly you found out exactly what I mean.  They will try to wiggle out of anything.
