Neighbors water flooded my apartment. She is taking too long to settle this.

My neighbor on the floor above us,  bathroom flooded into my apartment. She told us she is insured and we have called the administrator of the building, but nothing has happened so far. What is the next step because there is damage and  we want it fixed, as we want to visit our place. Do I need to get a lawyer involved at this stage or just keep on at her and the administrator of the building to get this fixed?

I would ask her to explain the timescales and reason for delay; likely the delays are not her doing and shes a victim too. 🤔

Are you insured yourself ? Get them involved.

Hi Lesk,

Does your Community make it a condition of ownership that you have home insurance, including Third Party liability?  In your situation, I would check with my own home insurers whether they could pursue the neighbour's insurer on your behalf.  You can then ask.your neighbour for their insurance details for this purpose.

We are both insured, the building administrator and a friend who lives in the building have told us to get our insurance involved, but  when we called them,  they said no , the people who live above us have insurance, and they need to take care of it. 

The lady who owns the apartment that flooded us has said oh, the Insurance has not responded. It seems like she is not motivated to get them out to look at the place. .  The water went into the people below us too, but it  seems to have dried out, we got the brunt of it, and I am scared that there is mold, starting to grow, and our neighbor friend told us the door frames and doors are buckling.

They insure you / protect you.

You claim from them and they pursue her if they want to, thats why your contract is with them

I think your company is trying to mislead you and taking the easy option.

 Your Insurer  needs  to get involved.   You have  damage to your  property   and that  is  what the policy is for.  It  is for your Insurer  to worry about  where   or  if  they can  recover     the cost  of  repair from  anyone

She pays insurance to cover her, not you and if she chooses not to claim for her damages that is also up to her

You pay insurance premiums to cover you, irrespective of where the damage comes from, so if you want to claim on your policy for the damage you incurred thats up to you

It really shouldn't be so difficult
