We are due to drive to Denia, on 2 October for possibly up to 6 months. My parents live in Denia and say we should cancel our trip, our friends here think we should go, but then my friends don’t know what real lockdown is like. We don’t have to come we can delay but obviously would rather not, is it that bad and is it getting worse. We have it easy in the Channel Islands so I’m asking for people’s opinion? Thank you so much Sarah

Hi,

I live in Benidorm and have heard rumours that Denia has a high Covid rate at this time. It would not be right for anyone to advise you to visit there with the risks involved.

You do understand that you are only allowed to stay in Spain for a maximum of 90 days in 180 days otherwise you are expected to apply for residency.

Hi thank you, we did want to apply for residency but not fiscal residency.

Hi,

You do understand that to achieve residency you will need to prove that you live in Spain full time and permanently.

You will need to prove that you have enough income to satisfy the authorities you won't become a burden on the state and that you have a Spanish bank account with that income going into that Spanish account for the last three months and outgoings being paid to various companies to prove that you actually are living here in Spain. You would need to prove that you have full healthcare cover for you and your family paid for a full year.  You may be asked for a padron.

Those items I have mentioned tend to be the minimum requirements.

Hi I had previously tried to look into it but received lots of conflicting advice, and gave up. I am confused that to stay more than 90 days we have to prove we live there permanently, when we don’t, we stay for less than 183 days. So are you saying if we wish to stay for longer than 90 days we have to move there permanently? We have no problem with income and healthcare etc.

The rule has always been that non eu nationals are only allowed to stay in Spain for 90 days in a rolling 180 day period and if you want to stay longer living in Spain you have to apply for residency. After 1st January 2021 you will need to apply for a visa to visit Spain.

If you read Jim's Guides about the 90 rule that explains all you need to know.

If you stop in Spain full time for over 183 days you automatically become a tax resident and be required to pay taxes in Spain.

Hi thanks for your reply, my original question was about Covid 19, we don’t want to come on 2 October and end up in a nightmare, with lockdowns, or even worse Coronavirus. I know no one can predict what’s going to happen, but what’s your feeling?

Hi Sarah,

I think you’ve answered your own question. “Don’t want to end up in lockdown “ catch Covid 19. Both are very possible as infection rates rise. Only you and you alone can decide.

Good luck

Yes I agree thanks. Just wanted other opinions, we can delay for a few weeks, or more, or even cancel, so I guess we may just wait and see. 🙄

Morning Sarah,

As far as I know, the government in Spain has given each area the right to choose lockdown if they think it’s necessary. A national lockdown didn’t work before so why should they do that should they do that again ?  My advice is to go as planned. If staying  with your parents , you will surly be sensible and only go out to eat or lie on the beach or that type of thing.  If walking , you are required to wear a face mask which can be uncomfortable but as the weather cools, it will become more bearable. Should another lockdown be on the cards, you can decide to stay or make a run for it .

I cannot advise you about the covid situation in Denia but it can’t be that bad. We returned from Torrevieja last weekend and are in quarantine now but we had a most pleasant holiday so don’t mind.

Good luck
