Car accident

Recently, sitting my parked car another car it hit, damaged my rear bumper. The gentleman in the other car, Spanish speaking only seemed nice gave me his  phone and plate number. I had my speaking friend call him to see how to fix/pay for it. He now is no longer cooperative telling me it should cost no more than Eur 50 to paint the part else I should take him to court. Damage is obviously much higher than what he offers. What can I do now?

Really you should have filled in an accident report form, without that signed by both parties I think you'll likely struggle to get any satisfaction.

Have you got any witnesses because if not the other driver could easily simply say you ran into him!

You can try your insurer but if the cost of repair is less than your excess there will be no point in pursuing a claim.

Unfortunately I suspect you may be paying for this one out of your own pocket.

It may help with information for you if you take a look at the N332 website.   It is for English speaking people and is run in collaboration with officers of the Guardia Civil.   On the website there is also an English version of the Spanish equivalent of the Highway Code.

Hi,

    regardless, call your insurers and advise what happened with full details that you have available. The driver may try to lodge a claim against you. I doubt this is the first case of this type the insurers will have seen.
