Hi, we are on the 3 year point and renew in July for the final 2 years, no-one can answer your query on the 10 month rule because the NLV isn't 5years in action. All I can confirm is that when we send in the pages of our passport it is recorded how many days we have spent out of the country. I have had to supply a confirmation of a flight back into Spain as they could not read the date stamp due to smudging so I can confirm that they do scutiniise your dates.

The successful challenge is in respect of a rather narrow range of circumstances (as noted in the 3rd to last paragraph of the article) so I fear it would be inappropriate for other individuals to decide on a course of action off the back of this one court case.

Thank you for taking the trouble to respond to my query and giving me the benefit of your experience.

Whilst using the laptop the other day I was prompted to try out Bing's new search engine which uses AI.....I was able to access all I needed to know as the system can cope well with complex questions......I was also able to deal with other queries involving pensions, taxation in Spain and health care.
