I have read this, but have never managed to have them not stamp my passport. At the airport they won’t allow us to present ourselves together and while one told us all we needed was out marriage certificate, after travelling with it, they dismissed us out of hand and stamp the passport anyway.&...

I’m told that doesn’t matter, as long as we can prove we travelled together.

They wouldn’t entertain the handbook, so I’m really interested how you get them to listen to you?

Do you carry a printed version or?

We will be sailing into Bilbao, we at least hand over the passport’s together at a port, what would you advise handing over with them?

I carry our wedding certificate and the clause from the handbook for border guards, in three languages, have now twice not had my wife's passport stamped in Santander and Calais.

But they have always stamped his passport and not mine. Will that not be an issue? Thank you for your res

The passport stamping will be necessary as the days he travels with you will count if he travels by himself later on. It will not matter if you are travelling together. Just carry your marriage certificate.

THIS IS INCORRECT ,travel with your EU citizen partner/wife is not counted to the 90/180 day rule only is they travel on there own, I have found some very good information of facebook and I will post the details when i get a few minutes

Only going by experience. Maybe the border guards aren't up to date but my neighbour is in the same boat (Irish wife, English husband) and his passport was stamped. Didn't count when travelling together but he couldn't book to come by himself a couple of months later as he had exceeded his 90 in 180 as English only.

Also know of one couple same situation who didn't get their passport stamped.

I suppose, one day, the customs and border guards will sing from the same song sheet.

I have found this page on Facebook, https://www.facebook.com/groups/133217347273496/posts/1007798776482011/

It deals with the subject in detail with the EU law to back it up, in the files section of the group, there is the border guards handbook in French, Spanish and English, I have carried a hard copy of clause 2.1.2, google translated in the past.

I now have a new document with copies of the actual clauses from the thee handbooks

Appreciated.

It is vital that things that have gone wrong are not put as fact to the way things should work, it is important that persons with the benefit of EU citizenship do not let border guards breach the rules and deny then their benefits entitlement, that is why I shouted.

Perhaps you can pass on the correct rules to your neighbour.
