I hope somebody can help with this. We have lived in France for 25 years but have now bought a house here in Spain and need NIEs.  Arriving here from France there are no passport controls as we are in the EU.

My husband is British but has a 10 year equivalent of the TIE for France. We have now been told by our lawyer that he needs to get his passport stamped in order to be issued with the NIE. In order to get your passport stamped you have to exit the Schengen area. I don’t need this as I am a European citizen.

The question is where can you get the passport stamped short of flying back to the UK, we are going to drive back from France via Jonquera.

Has anybody got any ideas?

Drive through Andorra?

I don't understand the passport stamp because you can obtain an nie from outside Spain from a Spanish embassy or consulate but I'm not an expert by any means.

Thank you for replying. Not driving through Andorra but the boarder after Perpignan. We were not aware that we could still get NIEs at embassies outside Spain will definitely try this

Hi Suzie,

Do you mean an NIE or a TIE?  I ask because you say that you've bought a property in Spain, but you wouldn't have been able to do that without having obtained an NIE.

Many people in Spain, especially the Spanish, incorrectly call the TIE (Tarjeta de Identidad de Extranjero) the NIE (Número de Identificación de Extranjero); however, they are different documents.  The TIE is the national ID card and the NIE is your unique tax reference number - hence, why you need one before you can buy a property in Spain and, as Myra has said, you can obtain an NIE from the Spanish Consulate in London:

http://www.exteriores.gob.es/Consulados/LONDRES/en/Consulado/Pages/NIE.aspx

Despite the site saying you shouldn't use this route to apply for an NIE if you intend to become resident in Spain, when you complete the application, simply state that your husband wants to open a bank account in Spain.

(As you're an EU citizen, presumably your husband applied for his Carte de Séjour in France as your spouse.  So now, post Brexit, is your lawyer actually applying for a TIE for your husband, rather than an NIE, again as the spouse of an EU citizen?  I can think of no other reason why he says your husband needs a passport stamp showing that he has left the Schengen travel zone - presumably, Spain doesn't recognise your husband's French residency.)

Kind regards,

Kim

Thanks for that. We actually talking about the NIE. We have not completed on our Spanish property yet. There has been a shortage of slots for the NIEs in both Denia and  Benidorm, according to our lawyer, who is trying to organise it. She insists that my husband needs a stamp in his passport in order for them to issue a NIE, and to get the stamp you have to come from outside the Schengen area, ie UK.

Although my husbands carte de séjour looks exactly like the Spanish TIE card, but in French, and should be exactly the same in the United States of Europe it seems it is not accepted, it is all very confusing.

We have not even got to the TIE saga yet.

Perhaps I was a bit unclear in my question, I wondered if anyone have had a similar situation to us and how they sorted it out.

If your husband holds a UK passport then unless things have changed I believe he will need to return to the UK and start the process for the TIE at a Spanish Consulate there so sorry to say more hassle for you.

Hi,

A friend of mine has just done this to obtain a TIE , she had a carte de sejour and went to the Spanish consulate in Bordeaux to get a non lucrative visa, it took a few months (they issue a NIE with the visa), then she travelled to Spain had her fingerprints taken and she picks her TIE up in two weeks

hope this helps

My daughter obtained an NIE number from the Spanish consulate in England before coming out to Spain. It was very easy and efficient
