I have so much sympathy for you. Being president of an urby is a nightmare. I know from experience. Whatever you do and however you help you always have someone causing problems. I would let the administrators sort it out that us what they are paid for but again from experience in our urby they are all pretty useless just want the money and generally not interested. Dont stress yourself out over it you are only a representative for the administrators donkey them take the stress.

Thank you , I,m try not to get to much stressed ,,,, I,m able to put problem aside , out of my mind for a time as we are looking for solution . I,ll say peacefull solution .

Some friends of ours have a similar problem. Their neighbour has built a 2.3m wall without permission and has left it unrendered on our friends' side. Our friends tried to reach agreement with their neighbours, but relations broke down. The architect at our Town Hall has confirmed that the maximum height allowed is 1.8m, so our friends have submitted a formal complaint to the Town Hall and await the architect to take enforcement action against their neighbours.
I think the owners of Nr. 13 need to make a formal complaint about Nr. 12's development to their Town Hall. Whatever community rules you have, they do not supersede planning regulations.

Hi Kim does a planning licence given by the town hall supersede community urb. permission? My question is specifically in relation to a planning licence being given to increase the depth of an existing conservatory by about a meter. If the neighbour objects to the renovation can it go ahead because the licence has been granted? Thanks

No, because Communities of Owners in Spain are regulated by the Horizontal Property Law (Ley 24/1960). Some Town Halls will ask people applying for planning permission whether they have obtained permission from their community already. The place to start is with your community's rules. (To be honest, the more common problem is people who think, having obtained permission from their community, they don't have to get permission from their Town Hall!)
