Confused by none residence taxes! My partner and I jointly own a property here in Campoverde. We do not rent and leave the paperwork to the lawyers, therefore, we pay a lump sum each year in December. Question: is the amount we pay each year for the current year or is it for the previous year? Why am I asking?

For the last 3 years, we have paid none residence tax. Last year (2020) we paid the full amount (half each) on 29th December 2020. However, on the 10th December 2020 I became a resident. If the bills are for the previous year but payable this year (2021) then we obviously need to pay the full amount again. However, if the tax is payable for the current year in arrears i.e. (1st January to 31st December 2021) and I have been a resident since 10th December 2020 then I shouldn't be paying.

Does anyone know what fiscal year we are paying for, and if the lawyers are right to bill me again?

I am on the understanding that taxes are paid in arrears, so you’re non resident tax paid on the 29/12/2020 covered/paid for the year 2019. Non resident tax for the year of 2020 will therefore be paid at the end of December 2021. As you received your residency on the 10/12/2020 and in the second half of 2020, for the year of 2021 you will be classed as a fiscal resident and for being a resident the tax for 2021 payment will need to be paid the first quarter of 2022. So no need to pay non resident tax for 2021 payable end of year December 2022. Please clarify if you’re partner also gained residency? As if not your partner may need to pay non resident tax if the property is in both names and you both have equal shares.

Peter has given good advice.   Everyone has different circumstances.

Try this firm below as recommended by many including myself who have used their services.

Only charge €20 per person to do all paperwork online.

As your partner has not gained residency so far in this year and if does, your partner will have to pay 50%? non resident tax for this year 2021, payable December 2022. If your partner gains residency from now until the end of July 2022 the Fiscal residency tax will be liable the first quarter of 2023. If your partner gains residency from/after August 2022 your partner will start paying fiscal residency tax the first quarter of 2024, but again will have to pay 50%? non resident tax for December 2023!!!!!!! yes it can be very confusing, so seek advice and yes the company MeathMaria has recommended have been mentioned before on this website, good luck and stay safe healthy and Sane!!!!
