Fraudulent Banking

The story is outrageous.

Maybe when you first went in, you should have said the words 'Guardia Civil'?

What is really hard to take is the fact that Sabadell admitted an error was made, they have admitted they have not insured our property, yet they sit behind their desks at Sabadell blaming everyone else and have taken 489 euros into the bargain.

The fact that we don't appear to have a leg to stand on just pisses me off is  I feel they are laughing at us and we can't do a thing.

Do you have the original paperwork for your house insurance with Sabadell? (There'll be lots, we've been there)

Are your signatures on the paperwork to say that everything is correct? Is everything correct on the original contract (address)?

If not, then I'm sorry but the fault may be yours. I don't think that even Sabadell would just make up an address to insure.

Don't forget that you have to give your insurer at least 1 months written notice (used to be two months), before you can stop them re-newing your insurance.

That said, I really feel sorry for your situation and would advise that you get better/cheaper insurance and avoid any dealings with Sabadell

Move all your direct debits to another bank account and close the account with Sabadell to avoid any similar scenario next year.

Do you have to have a Spanish bank account ? If not open a Wise account as many of us on here have done, they can pay your direct debits, no monthly charges.

When I started to read your post, I thought someone had taken out insurance for a property in Daya Nueva in your name, which would be fraudulent, but I couldn't understand how that would lead to Sabadell debiting your own bank account.  Then I read, "my brother took out the insurance, so he has to change the name over."  So now it isn't clear to me what your complaint is - does your brother have insurance on a property in Daya Nueva?  Or have you moved from Daya Nueva to Rojales, and neither you, nor your brother, cancelled the insurance policy for the Daya Nueva property?  If the latter, than I'm afraid I agree with Peter Pan, you should have arranged for the insurance to be cancelled within the required timeframe.  I agree that Sabadell are being less than reasonable, and certainly not customer focused, but I don't think it's fraud.

Stopping  a direct debit isn't cancelling a contract, it's just not paying. Th outcome of that depends on who you are dealing with and what you and they have in writing.
