Can a Non Resident change their licence from uk to Spanish ?

It doesn't make much sense. Anyway you must provide proof of an existing permanent address.

We are in the process of winding up businesses in UK so cannot start residency until later this year. According to CAB  if we don’t have Spanish licence before 31st Jan will have to sit test in Spanish.

If what you say is correct then the CAB advice is badly worded.

If there's a no-deal Brexit, then an application has to be made by January 31st, at which point the UK license will be retained and a temporary permit issued, after which you have nine months to make the appointment for the exchange. The application can only be made if you have residence here.

As it appears there isn't yet going to be a no-deal, then I'd expect the application date to be extended to December 31st.
