6 months in any 12 months applies to a non resident person. The confusion here is that this applies to the person but not the car. As long as the car is fully legal there is no time limit. It is illegal for a resident to drive a foreign car, but a second home owner (tourist) non resident can have a foreign car forever provided it is fully legal, he/she can stay for 6 months then put the car in the garage and use it when he/she returns. It may seem barmy but it is the law, or lack of it. A new UK car does not need a MOT for quite a few years, so can easily be fully legal.

I am not trying to win an argument but just state the facts.

The road blocks are regular near Guadamar on the N332 at one of the roundabouts and in Cabo Roig at the pyramid roundabout again on the N332.

It's still not clear and my legal advisor isn't sure either, as the rules refer to residency and not the actual vehicle, ie the car remains but the owner is not a resident and doesn't spend more than the required amount of time to require residency.

Quite right. A lot of comments on here are what they think the law should be, but it’s not, it is ‘’Posters Law’’ and totally wrong and misleading. The fact is that there seems to be no law on foreign vehicles being kept by non residents other than they must be fully legal. There has been plenty said but no facts other than

''Pensioners, second homeowners, cross-border commuters, self-employed cross-border commuters (company cars)

As an EU nationals with a second home in Spain (that you use for no more than 6 months a year), you do not need to register your vehicles here.''

Please can we have facts with evidence instead of opinions with insults and abusive comments?

Well I tend to agree with Nakabandi's last comment. As long as the Brit. reg. car is FULLY LEGAL, which means taxed, insured and mot,  ( new UK cars don't need mot until 3 years ).  it can be used in Spain by the 'tourist owner' for up to 6 months of the year,,...who can then park it up in his/her garage in Spain for the remaining 6 months, and then on return to Spain take the car back out of the garage to use again.

That's how I see the rules.

The words “fully legal” are key here.

I suggest that in order to ensure this state, everybody contact their insurance company and ensure they have written confirmation that the car will, in fact, be legal in these circumstances. It is too late when somebody else crashes into you to then find out you are actually uninsured despite your belief to the contrary.

Yes insurance needs to be checked. My UK LV Insurance says covered in Europe is for 180 days per year.

I asked my insurance company, they said I am covered for up to 90 days at a time, that I must inform them when I leave UK, and when I return.

I am going for two three month periods a year. If I was to ride my motorcycle there and back each time, I would be completely legal.

However, such trips are rather too much for both myself and my 49 year old BSA motorcycle which does not require an MOT as it is an Historic Vehicle. What I would like to do is take it over, and leave t there, whilst only using it during the 90 day periods I am there. I appreciate that I wont be covered for theft whilst I am away, but my concern is obeying Spanish law. Is it stated it is a requirement the vehicle be taken out of the country and is such a thing recorded?

My other concern, and the reason I wont get it registered as Spanish on Spanish plates, is that it is a long way from being exactly as it was when it left the showroom in 1971, A requirement to resister it in Spain I understand. As its a scrambler, it doesn't have indicators, though road legal in UK, would this automatically make it road legal in Spain?

Had my UK van here for 9 months got stopped in torrevieja in s general vehicle check never got van back , seemingly the Guardia had took a previous note of my reg and new I had van over 6 months in Spain

That is the law ignore if you wish best trade in and buy a Spanish car

I love this forum as it amuses me to see all the different characters strut their stuff.

Ray D is the oracle and certainly has put together some superb guides but calling people pillocks and morons although not particularly offensive does give the impression of arrogance, never a nice trait on a helpful forum, sorry Ray but you can come across as a person never to suffer fools gladly, but its still rude to treat people as fools when really its just your opinion. But having read all the posts im still no wiser in respect of how long you can keep a uk registered car in  Europe. However the local police in my area of Pilar de Horadada they rule that no longer than 6 months is the period allowed, and they have seized one vehicle to my knowledge although it was for well over this time limit and i dont know if the vehicle was fully legal ie having a valid MOT.

The moral of this is if you are unsure of the legality take an interpreter if needed and  ask your local police.
