Hi Kasha

Thank you for getting back to me. One owner has checked with his lawyer and confirmed it is only the application and that the license would come to his post box. Can you tell me how you got yours? Was it sent via post to yourselves or lawyer?

Hi

To advertise you need a licence number.  This is a guide to getting that number and what your property needs to have to qualify for a licence

As soon as you have that number, which will be VT-6 numbers-A, you can start advertising BUT there is more to it.

You must then register with the Guardia Civil so you can get your password for their web site and enter the passport details of all guests over 16 years of age.  If you have someone who looks after your property (keyholder) then you must also supply their details too to the Guardia Civil (so make sure your keyholder is working legally too!)  You also need to purchase your official plague and the official complaints forms.  The plague and the official notice saying you have the official complaints forms must be displayed at the property.

The taxation situation hasn't changed, it remains as it has always been.  If you are a Spanish tax resident then you declare your rental income as normal on your annual return.  If you are resident in another country then you file a quarterly tax return in Spain and pay the Spanish tax quarterly - obviously you also declare the income in your own country according to the laws there too.

Fines are high for not being legal.  The law changed in May 2015 (earlier for those renting out more than one property) and the authorities feel 3 years is more than enough time for owners to have obtained their licence, so they announced earlier this year that they would fine anyone advertising a property without a licence number after 1st June.  That is why the various holiday letting web sites wont list your property without a number as both they and you can be fined.  It really is not worth the risk of renting illegally.

Thank you very much for your explanation , that is very useful!!! I’ve got the license number but it starts with AT ( you think is that right ?? ) and I’m trying to finish the rest of the process but everything takes a lots of waiting for everything.

Hi Kasha

All the info I have seen over the past 3 years or so has said licence numbers for Valenian Communidad are VT numbers.  I am unaware of any AT ones.  The only A is at the end after the six numbers.  Can PM me attaching a copy or photo of the form with the number on?

Hi Bev

The info you have given is very informative. The two properties that I look after that have applied for a licence have got their application number but awaiting the official licence. One owner already had bookings from holiday lettings so sends in his earning etc to his accountant (I don't get involved with this) and pays his tax. But I don't think he realises you had to register with the police etc so I'll inform him of this and everything else you have given info on

how and where do i register my property to rent out i new to this and would like to rent my new apartment its Oasis Beach 9 Punta Prima can anyone help me with the process please. Then i can look for a decent legal keyholder/ cleaner

However the first step is now to obtain a certificate of compliance from the town hall then complete the forms and send with the relevent documents.  If you do a search on this forum for Tourist License you will find plenty of info (including a 6 part blog!)

You'r e looking at a period of at least 6 months from submitting your application - probably longer with the Brexit comedy ahead of us.......I'd advise you not to base any of your financial forecasts on receiving a rental income this year
