It was just that the man you were replying to about the UK/Spain issue was also taking non-sence about the USA, otherwise I woudn't have mentioned it. We are on the same page about the border controls.

Yes very happy to explain 'My' understanding of the rules

I as an EU (Irish) Passport holder have freedom of movement. I have not renewed my UK passport at the moment but will consider renewing as and when I might need it.

My wife and family (dependant and under 21's) are covered by 'Treaty Rules' as I read them in our case when we need to carry our marriage certificate, and copies of our passports in case we travel alone which is unusual, we have no children that qualify.

In checking what I say I found this

So if you do not become tax resident in a country you are free to travel and stay (I think with an EU passport, unless someone can correct me)

Wow...

One of the most vocal "Brexit's going to be great, I wish you'd all shut up with your Project Fear nonsense!" proponents on this site has created a thread in which she concedes that she is *still* completely ignorant of the "new" rules regarding travel in & out of the Schengen Zone, despite several people clearly explaining it all to her...you really couldn't make this shit up.

For 4 years we've been telling you that it would become harder for non-residents to travel & spend time in Spain but all you ever did was slag us off as "remoaners" & tell us to "get behind Brexit."

And now this...

I'm genuinely staggered.

Are you prepared to concede that you may have got it wrong & should probably have paid a bit more attention to those of us who clearly knew a lot more about all this than you did yet?

Granny Rose (the person who started this thread) has spent the last 4 years (that I know of) telling people like me to shut up & get behind Brexit because it would all work out great & any concerns about possible impacts on people with second homes / Brits living in Spain were "Project Fear."

She has repeatedly & consistently poo-poo'd any & all attempts at educating her (& her poorly-informed ilk) & has been a constant supporter of Brexit since Day One.

She's always tried to portray herself as being well-informed on all matters Brexit & has been utterly dismissive of those of us who have quietly & consistently tried to offer counter arguments (using actual facts & evidence rather than her opinions & beliefs), so to now see her suddenly create a thread which basically says "Oh, I hadn't realised it would affect *my* ability to travel to Spain" is frankly beyond the pale.

Stan you are correct. Things are much harder.

An Irish passport holder is still out of Schengen Zone as was the UK. Eire is still an EU member state but they are not in the Schengen zone. They choose staying with the UK/Eire free movement agrement, which is outside the EU schengen agreement. Not every EU state is signed up to it and the rule has been very laxed.

There is even an EU schengen travel calculator. Why would there be such a thing if the rule didn't exist? The 90/day stay in 180 days is in force since the 1st of January 2021for UK citizens. The 90/180 day rule is NOT 90 days in Spain and then move onto France for another 90 days and so on. It is 90 days in the EU in total.

Some people don't seem able to accept the facts. Eire citizens maybe able to stay longer but not really under strict schengen rules as they are not signed up to it. The Spanish in the past didn't care as the UK was a member state and they like the extra finances coming into their country.

Now our UK passports are stamped in and out. The only way round it is to apply for a longer stay visa. We also now need international driving permits for each EU country you visit, before this was not necessary. Things are different that is for certain. I still know several people living in Spain without their residencia. What will happen when they need to go out of the country ??? There will be problems for sure.

You say "the only way round it is a longer stay Visa"....  a NLV isn't something you can use to circumvent short stay immigration rules. Trying to do so while residing for long periods in the UK will eventually lead to immigration problems for the holder.

The Visas available for UK Citizens wishing to use one in Spain are very clearly set out on the UK Government website. 

There is no Visa that offers (for example) an extended stay beyond 90 in 180. There just isn't. The Visas available are there for UK citizens who wish to live and work in Spain, retire to Spain or study in Spain.

I do understand that it's in the nature of some Brits to try and game the system with Residencia, tax, healthcare etc, but I don't see any loophole in the Visa system.

I think I had read that a non Eu citizen in a family group with EU treaty rights had to get a visa to stay over 90 days, but cannot find it now.

but at that time I had not found the Irish web page which does seem to explain for EU citizens and families.
