How do the rules apply to BnB? We have just bought a property in a rural area but close to Elda and Pinoso and would like to convert a reasonable sized garage to a BnB apartment. Any issues to look out for?

To run a bed and breakfast would need a business license. You would be best to get proper legal advice to make sure you can open a bnb and set it up correctly.

Hi I have an apartment in pilar and have been told since February that the town hall is not accepting applications so I can't even start the process. I have tried 3 solicitor s with no joy. I only bought the property in November completed February and can't rent out this year does anyone know any different or if things will change, they have all said later this year? Thanks

Ally it is a requirement. People said for years not to bother declaring your rental income and paying tax, then when the law changed in 2015 requiring licenses they didn't bother with that, and it is exactly that attitude that has led to where we are today. It is all part of the one system, and eventually people will be caught out and fined who are not complying with it all.  My advice is do not take the risk, it isn't difficult to do.

Jimi, sadly it is up to each town hall to make their own decisions. There is literally nothing you can do until the town hall start accepting new applications for compatibility certificates, so if they restart in the autumn you will still be pushed to get a tourist license by next spring.

When this new first stage came in last July I don't any town halls were ready, then came the August skeleton staff only month, so by the end of September they were only just getting to grips with it and most had a massive backlog already. 

You only need a tourist license for holiday lets . You can still do longer or mid term letting. There is a demand for 8 to 12 week lets  particually over the winter months. That might be an option for you.

The room sizes are not a new criteria but they used to take your word for it rather than you have to prove it with a certificate or inspection.  You estate agent and Karol's should both have taken on board that you planned to rent it out and not shown properties that don't meet criteria.  As a property finder I have been nagging agents for over 4 years about this - if our clients are looking for a property that they plan to let out then we always make the requirements clear.

Mid-term rentals are longer than holidays lets (which are generally considered to be up to a month) but where the renter isn't there long enough to make it worth them taking over paying the utilities etc and usually for a fixed or maximum time period.  So stays of 2-3 months, or even up to 6 months.  They still rent a fully furnished and fully equipped house (as per a holiday let) and the rent includes all bills.  Long-term is when the property becomes the renter's permanent home and they would become responsible for all utilities, usually contracts are minimum of 6 months but often in Spain the minimum is 12 months and a period of notice has to be given by both parties if the rental is to end or terms change.

Each town hall sets their own system for the CERTIFICADO DE COMPATIBILIDAD.  Some have suspended issuing them at present, so it really depends where your property is as to how long it will take to obtain.  The best option is to ask for current information at your local town hall as that would be accurate for your location.

Yes ours took exactly the same amount of time. Now just waiting for the Tourism Licence.
