Hi Stan - good to hear from you again, will be a shame if you feel like ifs time to leave the forum. Don’t let the idiot John***** cloud any judgement of the forum comment, Kim’s input on the forum is overwhelmingly more useful, productive, informative and receptive than John’s, who seemingly automated monotone response is along the lines of “Maybe you can find something constructive to do also”…..is the most childish and laughable response!

I hope you decide to stick around Stan, over the years I have read many threads from yourself and been appreciative of them all, you are a man of knowledge of the CB area and far more helpful than certain others …..👍

Please do heed the Spanish Tax laws regarding selling a property in the Uk or anywhere. You must sell your ex-home in the UK before becoming a Tax resident of Spain otherwise you will be liable to Capital gains tax in Spain. On the 183 day of residing in Spain you auotomatically become a Tax resident of Spain. CGT in Spain is high. You don't want to lose any money you may have made on selling your UK home. In the UK you do not pay CGT on a home you have lived in on a permanent basis.

Hi,

You are fine to go back to the UK as you do not have to make an appointment to pick your TIE cards up from Alicante, you will have been given a lott number when you went for your fingerprints doing..when it gets up to your lott number you can go any day to pick your cards up..

We are on a NLV and have just got our visa's for years 2 & 3...

I’ve read all the posts on this topic and I’m sorry that it became personal. Both Kim and John gave excellent advice to the poster but in truth, John felt that people should seek expert advice on such an important matter. That said, to fall into the trap of getting into a slanging match is unnecessary and upsetting for all involved. Forum members are loath to offer advice because of this. Many of us may feel like commenting but don’t. This forum is invaluable to many of us and we don’t want  to lose anymore good members. 
Slow down and think before hitting the keys. 

I hope this will be the end of this and I’m hoping John will make a simple apology to Kim.

Not quite. You become a tax resident in Spain once you have been here for 183 days or more in a calendar year which is the same as a fiscal or tax year. If you move over in, say, September 2023, you will not become a tax resident in February 2024 (6 months later). You will become a tax resident in June 2024 which is 6 months into the calendar year. You will not have to complete a tax return for 2023 as you were only resident for 4 months in that year and your first tax return will be completed in 2025 for the full 2024 tax year. Spain does not have part fiscal years.

If, however, you move over in, say, April 2023, then you will become a tax resident for 2023 as you will have been here for over 183 days in September that year so will have to complete a tax return in 2024 for the whole of 2023. Again, Spain does not have part fiscal years so your income in the Jan to Apr of 2023 will also have to be declared.

And going back to the original, as a temporary resident, which you are classed as before you have been here for 5 years, then you cannot leave Spain for over 6 months in any one year nor a maximum of (caveat, I thought it was 1 year total in the the first 5 years but maybe 10 month is correct). After 5 years you become a permanent resident and other, much longer absences, are allowed.
