Hello Ex Pats

Me and my wife are wanting to come out to Alcoy and rent a property whilst we are looking for a house to purchase (around May/June). We have the possibility of a short term let from March to October, however, our spanish lawyer has informed us that we cannot apply for residency whilst in this kind of letting agreement.  Obviously we would be living in Spain for more than 3 months and would need to apply anyway.  We are confused because I can understand not being able to get the Padron as you need to provide a permanent address, but as far as we can see for residency you don't.  Can you give us any advice please?

You need a proper rental agreement which presumaby you won't have with what sounds like an extended holiday let.

The law doesn't actually require proof of a permanent address in the form of an escritura or long-term rental agreement or padrón, although this would certainly help, given that most national police stations ask for proof of residence.

The way around this is to ask the town hall where you are renting to give you a temporary padrón to see you through the residency process. If need be, show the town hall your appointment for the residency certificate application.

Thanks for all comments, these places claim to be a permanent address for residency but I will look into that one.

Hello Nigel,

Not sure I understand the question but I lived in Alcoy  for several months whilst looking for a property eventually got one with no problems but had a solicitor throughout. We have our pardon and all necessary paperwork. Our solicitor was/is based in Alcoy and happy to recommend if you wish. She was very helpful and competent and dealt with everything promptly. We still contact her with any queries we have.

It may help you with all the queries that you will have if you look at Jim's Guides on this site.   Also the Citizens Advice Bureau Spain site may also have some answers  regarding general queries.   There is also the N332 site for anything to do with driving in Spain.   The latter is run in conjunction with officers of the Guardia Civil for English speaking people and has a Spanish equivalent of the Highway Code.  

Just be aware that many things may change after the end of this month, and particularly after the end of December 2020, and also that many provinces and towns 'tweek' national rules and regulations for their own procedures.
