Extra urbanisation fees

Hi there,


I realised that 165 euros had been taken twice from my Spanish bank account and queried this at the urbanisation’s admin office. I was informed that this was on top of the quarterly urbanisation fees and were for repairs to a garage which I don’t use and a tennis court I don’t use either. I hadn’t been informed of this before monies were taken. Two more payments are apparently due.

Has anyone else come across this? Is it legal? 

Any advice appreciated.

This will probably have been discussed and agreed by majority vote at the AGM (or EGM if the work was urgent). You should have received the minutes from the meeting, even if you were unable to attend.

Unfortunately, not using the communal facilities doesn't mean that you don't have to contribute.

I know it’s a different way of doing things but I’m shocked that money can be extracted like this. Surely I should have received notice of how much and when this would occur.

Hello

 Your administration   should be able to explain when the date/amount for these fees was agreed, As PeterPan says these decisions are usually agreed at the annual AGM - this happens at my Urb but we do get an extra email when the amount is due to come out of the bank

Admin or President  should be able to  answer your questions.

Thanks a lot. I’m just going to have to get over it I suppose! 660 euros for something I have nothing to do with came as rather a shock!

Any decisions affecting disbursements must be voted and taken unanimously - majority is not sufficient. Neither the president nor the administrator have executive powers, everything needs to be decided by the owners. AGM has no rights to limit or seize whatever is within boundaries of each individual property excepting exterior walls, roofs, terraces and balconies which are considered part of the condominium. Anetenas, SAT dishes etc. mut be tolerated.
