Landlord selling long term rental property

Hi..

I have lived in the same rental apartment for 2.5 yrs and have long term agreement (5 years).

My landlord is selling said property and the first viewing took place last week. Said contract does state landlord has to give me first refusal and 2 months notice if he / family require to live there. Said contract doesn't say anything about selling etc. He has said he will give me adequate notice as and when sale is agreed. I'm just trying to establish my legal rights re repossession , notice period and bond return. I do plan to seek professional advice next week but wondered if anyone had any experiences and / or advice. Thanks in anticipation

Oddly enough, I have searched those same websites earlier today which helped me to conclude I need face to face advice with a professional to discuss my particular case..

Identical possession clause in 5 yr contract as posted by the original poster..no mention about sale and related process.. strange oversight as I expect many landlords will require sale at some point..my gut feeling is that it's down to tenant / landlord reaching amicable agreement for possession.

BTW I have just sent a private message to original poster requesting outcome / advice.

Good. In several european countries like France the owner has an obligation to offer the tenant to buy it first. In others like in Scandinavia you will sell with the tenant «in» the property and the new owner will give the tenant notice of leave if they want to use the property themselves or continue the contract … In spain it is the same as in france: nb Land Registry makes the difference in Spain

Many thanks..yes. that was something else I found out..said landlord didn't formally notify me of pending sale and / or offer me first option to buy ...

Believe it or not he sent me WhatsApp message asking me if I would be available for someone to visit...

I had to ask twice for more details as i was concerned for my security

Only then, did he admit a prospective buyer wanted to view accompanied by an estate agent..unreal..

As you can tell, I'm just currently getting to grips with said contract legalities to be used to my best advantage as and when a sale is agreed..that is the time for maximum leverage for best outcome for me..

He will not want to lose said sale..

I understand. I feel sorry for you. 

Whichever law - in any contractual agreement transparency should always come first. Especially concerning someone’s home and it’s your home (even if his house).
