Dear All

Out of sheer desperation I have registered on this site for help.

To cut a long story short:

1. My elderly father (90 yrs old and blind) owns a flat in Calpe in  'Carrer Blasco Ibanez ' . He bought the place in 1980 and it was finally rented to a nice aged British lady for 20 years who then died.

2. Our letting agent at the time rented the flat out to the 'President Of The Block's son and he paid rent for 2  years and then stopped since 2009.  My brother and I have been trying through the courts for the last 4 years to evict this tenant but he knows every trick in the book to avoid eviction using free legal aid to appeal against eviction , even to the 'Supreme Court Of Spain'  . He has failed on every appeal and we were finally about to evict him yesterday . He owes us over 27k euros but we will never see a penny of it because he will declare himself bankrupt , trash the flat and run-up utility bills for us to pay.

3. Yesterday arrived and the court officials and locksmith arrived to evict  him but for some reason they said they were unsure about the location of the flat so the eviction was suspended yet again (maybe for another 3-4 months until a new eviction date is agreed via the courts of Denia).

We did send photos of the outside of the flat and the street entrance doors but they claimed that the 'street entrance' door does not lead to our flat and said that an Arab family was living in the apartment and not our tenant (so they were unsure and suspended the eviction).  They claim that we sent them to the wrong street entrance but we think the tenant has sublet our flat illegally which is why he has tried to drag the eviction out.

Now this is my appeal for help if anyone lives close to our apartment . Because my father is so old now he may have given us the wrong street entrance details (there are 2  quite close to each other).

Would anyone be willing to just enter 2  possible street entrances and confirm which entrance leads to my fathers flat?  I can send you the photos of the flat and 2 street possible door entrances that leads to the stairwell. The flat is on the 2nd floor and should be numbered ( I will send it to you via private message rather than use this post). 

There is one entrance right next to the Yasira boutique and clothes shop

The other is in between Churerria Restaurant and Diners Bar.

I hope someone can assist me if they live close to my fathers flat . It's impossible for us to visit Spain and be there for the next eviction date because of the Cov19  and I am beginning to lose all hope in evicting this tenant that has caused my family such financial hardship and worry.

If no-one can assist,  I was wondering whether there is a contact for the local postal service that can confirm how to access my fathers flat from street level?  If yes, do you have any contacts?

Not wishing to stick my nose in unnecessarily, but I had a look on Google Street Maps out of curiosity. The entrance next to Yasira at least appears to be controlled access by intercom into the building. Can't see the other one clearly because there's a tree in the way. Are you aware of that?

Anyway, good luck and I hope it turns out well for you.

Dear Sir - Yes we were using google streetview too and didn't spot the double doors behind the tree and also thought that the correct access was next to Yasira .

Our flat is 2 floors above the 'Diners Bar'  so I am suspecting that the correct entrance to the stairwell must be via the  doors hidden by the tree. I am so stressed out because the court officials have actually taken a photo of that door asking whether this was the correct street entrance but didn't even bother using it , go up to the 2nd floor and look for our flat number which is on the door. They just suspended the eviction immediately and will probably charge us another 500 euros to set another future eviction date.
