Hi...

I am about to submit an application for a Residence Card for Family Members of EU nationals.

I have a few questions.

1. Evidence of Marriage

I have legalised / translated our UK marriage and my birth certificate but the formal registration process via submission to the Central Civil Registry in Madrid can take between 6 months and possibly even 2 years apparently.

But I need to start the residency application by the end of Jan (as it will be within the 3 months of arrival to Spain).

Apparently this is possible whist the marriage registration process is underway? But I have not seen anything that offers advice on this. 

2. I am getting my Empadronamiento sorted next week but there seems to be a temporary certificate issued before the formal one - a Volante de Empadronamiento is issued on the day of application - and this is apparently suitable for official purposes.

I will need to start the residency application straight away, so will this temporary certificate be OK too?

3. Can Spanish lawyers actually submit your application without the need you to attend in person via a Cita Previa?

I am hoping there is someone out there who has been through this process?

1. As long as you have an officially translated copy of the marriage certificate that should be fine.

2. Only those who are resident are entered on the padron. They issue a temporary, up to 3 months, padron for the very reason that you can apply for residency within that time so it is the official document.

3. Hmm, we had to attend in person when we were originally on the register of foreign EU citizens resident in Spain. Obviously, with the TIE now, you must attend in person as they take your fingerprints at the first appointment and then check your fingerprints at the second appointment.
