Non resident tax lack of registration mistery

I delegated a forum recommended firm of tax agentsI have checked the deed  to fill the 210 for me and my wife and pay the tax due.

The agent came back to say my wife registration could not be found and he now needs with my authority to go to the office in person to do such registration. I have authorised him but I find , being new in Spain, this matter odd.

I called  my solicitor and requested a copy of the title deeds, she sent me a document titled escritura de compraventa  on which both my name and that of my wife appear. So how come the Tax Office cannot find trace of her ? Are oversights of this importance common here ?  I cannot suspect the agent for wanting to take more money out of me because he offered me a refund.

I have never seen a Spanish Title Deed . Is it the document that the Notaire prepared for the purchase final transaction and which is entitled Escritura ?

If you and your wife have a joint bank account and both your NIE numbers are on record at the bank, then their annual report to Agencia Tributaria should have put her details into their database.

If she hasn't been registered that way, then a registration must be made direct with the tax office.

I hope this message finds you in good health!

Do I understand correctly that it is neither the solicitor, nor the Notaria but my Bank that would have reported  our names and NEI to the tax authorities ?

Their oversight is going to cost me around 50 euros.

The title deed is the escritura. I don't understand why that is needed, but don't know enough to say it isn't.

Unless a Modelo 030 has been submitted to Agencia Tributaria to register somebody in the tax system, and this isn't something that a solicitor or notary would do, then the registration is made by the data that the bank submit.

Anyone with an electronic certificate can submit a Modelo 030 online, but I can't recall if it's also possible to submit supporting documents.

It remains a mystery. The Agent told me it is likely that it was the Solicitor whom missed out on the registration.

I will never know, but at least she is now registered although that means I will now have to pay her taxes too!
