We have sold our house to a buyer who has paid a deposit and signed a power of attorney with a lawyer. I am being told that they cannot pay the balance because they don't have an NIE, I think that this is b*ll*cks. If it is being done through a lawyer then why the drama. We are moving to the mountains so want to make things easy for the people we are buying off.

Thoughts from the forum most welcome.

The lawyer can obtain their NIEs with power of attorney. I can't see the problem.

You have to have an nie to buy a property in Spain. It's the law and there's no way round it. It's not difficult to get one and costs under 20€ last time I checked.

Hi Madcarew,

If the buyer doesn´t have an NIE, the lawyer shouldn´t have accepted the deposit in the first place - and giving that as the reason for not paying the balance doesn´t pass the "So what?" test for me.  What is the buyer/their lawyer offering as a resolution?  Are they processing the NIE application?  It´s not difficult.
