I just don't know enough about the subject. However, I understand there are two potential areas for claims:

a) if the mortgage contains a floor clause - clausula suelo.

and

b) a refund of the mortgage set-up costs.

If your bank hasn't already contacted you, I think (?) you should write to your bank setting out your claim, and if they don't respond favourably, then you'll need to take legal action. If you need to do this, then I'd try to find a lawyer who'd include his fees as part of the claim. But please don't do what I merely think should be the approach to take - you really do need to find out more about it.

The topic has been going on for several years now, so there should be plenty of information on the internet even if you don't get info from this forum.

I am no expert in this matter but I did make a successful claim based on a letter I prepared myself. I think all the banks have been instructed to set up a clear claims process and it can be found on their website. I spoke to the bank manager to find out how to access their process on their website. The courts don't want to have to deal with an avalanche of individual claims.

I would urge you to try and claim the money on your own as I found it straightforward and did not seek any legal advice. Whilst I can not guarantee you success with the following I am happy to share with you the information below which  I used and you would just add your personal information.

Dear Customer Service Centre- Floor Clause Department

I am aware that following the Sentence issued by the European Court of Justice in December 2016 regarding the retroactive effect of nullity of abusive Floor clauses (Cláusula Suelo), Spains Supreme Court has now ordered Spanish banks to refund their clients all the money they over-paid due to the Floor Clauses. I know the Supreme Court Sentence was issued on 15 February 2017. 

Therefore please regard this email as a formal claim to have my floor clause monies refunded to me with interest as required with effect from 2009. I understand you have 3 months in which to do this.

  I can confirm that currently I have not implemented any administrative, judicial or arbitration procedures against the BANK NAME to date.

  As you are aware my  mortgage contract has a floor clause contained in it. However its effects were not fully explained to me as the customer. Therefore I believe this lack of transparency andlack of information is the reason this clause is deemed abusive.

Yes the focus appears to be on claims for retrieving off plan deposits for houses that did not come to fruition. Happy to help you any way I can based on my experience. I did hear that  Spanish banks owe their customers around 3 billion euros!
