Your rules about works allowed on illegal propertiees are more generous than ours: It allows you to do maintenance work which doesn't increase the compulsory purchase value of your property (so no extensions)

Artículo 112. Régimen de fuera de ordenación o de norma.

Hi John

What is the 'compulsory purchase' value of a property? How would maintenance affect the value of that?

Sorry, do you mean a government land grab?

Hello John, the properties in the campo are still being sold even with the uncertainty that they are legal. Local estate agents are clearly getting around the situation by using loopholes or fake documents. A friend explained that a document called Decleraciones Responsibales could be getting use...

...d as a loophole? Can a DR be used to sell an oldish country house - replacing the Habitation certificate? Seems a bit peculiar to me.

Hi, a DR hass nothing to do with legality. It's merely a method for requesting a license. In no sense does a DR make a property more legal.

We have a public meeting at 11.00 this Thursday in Oriihuela library. I''d love to see you there, I'll be speaking and so will the Director General of Town Planning for the autonomic government.

All the best, JK

Hi John,

There are two public libraries in Orihuela, please would you advise at which one the meeting will be taking place?

Many thanks and kind regards,

Kim

Hey everyone, we have organised an MIT event in the public library Maria Moliner,

Plaza Salud, 1, Orihuela at 11.00 on 16th March (next Thursday)

We'll be going over the whole process of legalisation and people will have a chance to ask question either to me the Commissioner for Expatriates or to Vicente Garcia Nebot the Director General for Town Planning for the autonomic government of Valencia. The event is open to all: owners, agencies, lawyers, technicians.. It will be given in English but, in the Q&A we will answer questions in Spanish, English or Valenciano.

Here are some links about the licenses to help bring people up to speed.

Hey, if the property isn't legal it's the value of the land the property is on. The at was the big issue with the LRAU (what became known as the land grab law) one of aims of the LUV was tighten up abuses of cimpusory purchase orders, LOTUP has continued where the LUV left off. I haven't seen any recent abuses under either the LUV or the LOTUP so I'm assuming that bit of town planning is fixed. If you're aware of something I'd be interested in hearing aboout it.

Cheers, JK

The 'Eye on Spain' Forum is also very handy for getting info out to communities.

https://www.eyeonspain.com/forums/

Might be worth adding the MIT info there.

I think the process sounds great, if the route to getting the documents is simple & painless then any owner of a country house with administrative issues should seriously consider it. Thanks for the handy guide pack included in your messages 👍

Thanks a lot for the link, that really helps. I'll definitely post there on Monday, it's really life changing news for people affected by this problem so it's vital the message gets to as many people as possible.

Thanks again, JK

Hi Kimmy, yes. We have a series of outreach event, the intervention in Lliber is going really well. I'd like to repeat that success in the Catral/ Orihuela area as they've suffered in the same way but, on an even bigger scale. We just had an event in Denia and it wasn't a success as the local cou...

...ncil was in charge of letting people know about the event and they just don't have the contacts. I need to get hold of those affected to let them know about the opportunity to get informed and ask any and all questions about the steps to be taken to attain the license. Any thoughts?

Hi John I attended your meeting in Orihuela and we discussed together my MIT process . a group of 20 houses being dragged through the MIT pemit process. Amongst many of my concerns is the one fact that you were very definite about is that only the dwellings would gain the license and swimming pools would still remain illegal along with our out buildings . Our solicitor believes that this is not correct as our case is a cluster pemit. Can you please confirm for me if I stand to lose my pool and out buildings by continuing with this plan
