My wife is Irish and I am a  U.K. citizen,

We have been using an immigration advisor who informed us we need the following

Padron

Bank statements (3months)

House deeds

Healey care ( wife has S1 and I am biggybacking on it and have the certificate )

Updated and apostlled marriage certificate dated June 26

The advisor is struggling to get us an appointment  as it’s August but as the marriage certificate has to be dated within the last 3 months time is running out 

I was told we could just go to a national police station to start the process

But don’t know if this is correct

If you are an Irish citizen with an Irish passport you can move over to Spain and sign on the foreigners register at the national police station and get on with your lives. You spouse can then make an application to live here as the spouse of an EU citizen.

Hi,

Family members must apply for a residence card of a family member of a citizen of the European Union in person, within three months of their date of entry into Spain, at the Non-nationals Office) in the province where they intend to stay or establish their residence or, failing that, at the local national police station.

Hi Alan mac,

Your wife, as an Irish citizen, can apply to register on the Foreigners' List at a National Police Station.  However, this link to the Spanish Government website doesn't specify where family members have to apply:

So this leads me to wonder whether your advisor is trying to get an appointment at the provincial foreigners' office in Alicante, so that both applications can be done at the same time?  Availability at Alicante office has been very difficult for many months and the summer holidays are bound to have made it even worse.  If you could ask your advisor to be specific about the process and where they're applying for the appointment(s), it may help you decide whether you need to arrange for an updated apostilled marriage certificate.
