Hi Rob, I would not recommend following the route recommended in an earlier post, though I see it has now been deleted. Take a look at the article from the BBC posted last year, gives you an idea of the problems involved.

Sorry to hear your property has been taken over by squatters. There are companies you can hire to mediate but they negotiate with the squatters and money changes hands. Not a cheap way of doing it but faster than the courts. I suggest you go on www.registro.es which is the official Spanish Gov Registry of properties. Download and pay for a Nota Simple to make sure nothing has been altered in the Registry of deeds. It is an easy process and you will have the Nota Simple sent to your email. It costs about €14. You will need your NIE and the address of the property. The Deeds you have will not be acceptable as proof of ownership as they would have been issued some years ago so a Nota Simple will be a must. Then start the process of eviction with a solicitor. It can take up to 18 months. The Government were to update the law so that if the squatters did employ the ruse of not appearing in Court the judge would go ahead and issue the eviction order. I don't know what has happened to the legislation.

You will need

  1. Address and municipality (mandatory).

  2. Owner's name (optional)

  3. Property number and other data: registered property number that appears in the deeds or cadastral reference of the property. (It will be on your IBI/local rates bill)

I remember reading of some people who guaranteed getting rid of squatters. Fairly expensive at about €2,000 but they did the job.

This is an emotive subject. And you're dealing here with the scum of the Earth.

At the end of the day, it is what it is and they have (to an extent) the law on their side.

But this scum section of society are usually easily motivated by money.

And they're usually stony broke.

Get an intermediary (preferably a local lawyer) to make an offer of (say) 750€ to get them to leave voluntarily.

Now they know you have money and you're prepared to spend it.

Negotiate up to a maximum you're "comfortable" with.

Say 2,000€. Whatever.

You're facing literally years of heartache otherwise. And hefty legal costs.

How much is your peace of mind worth?

Find out who owns the place, possibly a bank.
