Neighbours cut back pine trees without asking for permission

Hi Everyone,

Arrived a few days ago to find our neighbours have climbed over our fence and taken all the branches off one side of a tree. The tree is located about 7ft from the boundary fence, so some branches may have been over hanging by about 2ft max.

However, I was under the impression the pine trees in Campoverde could only be cut back if a licence was obtained from the council and importantly the owner’s permission obtained. At no point have they discussed with us, any problems with this or any other tree. 

Do they have any right, to do what they have done?

Two concerns,

  1. If the town council now come along and see this tree with all the branches cut and left on our land could they decide to fine us?

  1. The tree has now been left lopped sided and could become a danger in high winds.

So how to move forward and keep some harmony!

I suggest you pop into the Town Hall satellite office on Plaza Florida, explain what happened and ask for advice.

Were the branches left on the ground ?  If so, the Council Tree Officer will be able to estimate when they were cut down (decomposition of pine needles, etc.), and if you can demonstrate your movements to/from Spain, you have the basis of a defence.

Due to Covid19, you need to make an appointment. I will PM you the email to write to.

Yes they are our trees and I do, do charity work, but thanks for the suggestion :)

If you read the post my concern was if we would be fined as the trees in Campoverde are protected and the authorities have been known to fine people heavily. 

I'll just pass the fine on to my neighbours.

This post is nothing to do with me, but I was interested to read it as I also have trees near the border between my land and my neighbour’s. And, reading the post accurately, the tree is on her land and could now be deemed as dangerous. 

But I am so shocked at your reply that I just had to comment on your rude remarks.

Unless being discourteous is your hobby, you just wasted your precious time unhelpfully answering like a grumpy old git. I refuse to suggest what you could have been doing, as I don’t, unlike you, believe I need to tell someone what they could have been doing with their time!

The OP made a perfectly logical request for information, got a very sensible reply.

End of. Get a life.

Trees are taken seriously in Campoverde.

We had to obtain consent, just to have ours trimmed.

Coronavirus does not exempt us from abiding by the law.

The OP had a serious and legitimate concern.

You are just inflaming the situation for absolutely no good reason.

Curiously, given all the hot air and froth being exchanged, our neighbours here have a similar problem. Their immediate neighbour is not here and hasn’t been for a very long time. He is the proud possessor of an huge pine tree in the middle of his plot (we live in the campo, literally at the edge of the forest which abuts our fence) They have just been to the local Ajuntamiento to ask what they should do, as much of it overhangs their garden. They have been told that it cannot be taken down without permission from the owner, but that any overhanging branches may be cut off back to the trunk.
