Tourist Licence for Property Rental in Pinoso

Hi 

We are currently looking to purchase property in and around the Pinoso area with a view of adding a casita on the land to rent out via Airbnb etc. 

We have read that it can be extremely difficult to obtain a Tourist Licence for this due to it being in a Rural Area? 

Any advice would be most helpful before we commit ourselves financially to it. The Rental Casita would be a new build and can be built to comply with all rules and regulations in order to obtain the licence if needs be.

Hello Kam

Before you can apply for a Tourist License you have to get a compatibilty certificate from the Ayuntamiento (Town Hall)  - with out that permission you can't apply for a TL so, the town hall is the place for you to start your enquiries

Trying to obtain a tourist licence for a property on rural land is an absolute nightmare. Be prepared to jump through all sorts of hoops and for it to take an extremely long time. You'll need to comply with all sorts of rules and regulations, including having a drinking water system installed. If you have a pool it'll need to be properly enclosed, etc. etc. etc. If you are going to be relying on having a rental income in order to live there, it's a very risky move. You need to get some INDEPENDENT advice from a solicitor you source yourself - not through the agent you are dealing with. There's also the size of the plot to consider. If it's less than 10,000m2 land you probably won't get permission to build a casita. Don't mean to burst your bubble but you need to think very carefully and get proper advice before you commit yourself.

Does the property come with permission for a casita to be built already?  If not, you may find that it is not possible to build one as planning laws are very strict.  Only one property is usually permitted on a plot of 10,000m2 min for rural builds.  Secondly the property would need to meet the size and standards required for letting. Urban and rural requirements do differ slightly but both require a License for letting for which you need permission via a certificate from the Town Hall before you can apply.  Have you already spoken to the Town Hall about their views on the building of the casita and the likelihood of being granted permission for holiday letting?  That is the first place to start.

thanks for the reply. Plot size is not an issue as it is approx 23000 m2, both fresh drinking water and irrigation water supplies in place. We are waiting for a Lawyer to call us today and we will visit town hall in a few weeks to discuss accordingly.

no the land is currently olive/almond trees so we are going to be starting from scratch. I have researched a little into what the requirements for size of the casitas would need to be so we will build one first to that spec or a little bigger as we need one anyway aside of rental which we will use until we have built our home on the same plot. then i suppose we will start the process of 'jumping through all the hoops' to obtain certification.

Only thing I can add is that be very careful how you proceed,especially as it sounds like you are building a casita and a house to live in.All permissions have to be gold plated or you can so easily find yourself in trouble.There are many people that will just tell you what you want to hear.
