Hi if I leave before 90 days and return but still not spend a total of 183 days then we should be OK.  Not liable for CGT in Ireland this year as principle residence,  Thanks for your help.

To make matters simple. We sold our U.K. house in April 2020. No CGT as only residence. We then rented till Sept 2020 when we moved to Spain and bought property we live in. Not tax resident until Dec 2021 then first tax forms completed Modelo 720 March 2022 and June tax declaration June 2022. No CGT to pay.
In year of a property sale count 183 days from 31 st Dec then move after that date it makes life so less complicated.

Thank you. That's what we plan. Sale will close end of July,  we plan to move over in August so will be less than 183 days in Spain.  Thank you for confirming that for me,

Hi

This is my understanding. We listened to a podcast provided by a Tax specialist in Spain who works for Chase Buchanan and he said if we moved after 4th July we would not be eligible to pay Capital Gains Tax in Spain from the sale of our property i.e. we will have spent less than 183 days in Spain during the year of our house sale. We live in England though, and in your position I would definitely want to speak with a Spanish Tax advisor before making such a big step

Do you mean capital gains? After £350,000. If the property is in  shared ownership. Husband & wife are you then taxed as individuals 50,50  or taxed as one?

Hi not sure what you mean. Were in Dublin. We don't pay CGT here as main residence abd should be OK in Spain once we spend under the correct days there this year
