He has been approached by his 2 sons, he refuses to discuss it, he says it is theirs now but they don’t want it, I do have photos but not sure if it would be ok to put on here. x

I feel so sorry for you. You find yourself in an awkward and horrible situation with no way out.  You could simply choose to ignore the situation but in doing that, you are lowering the tone of the area you live in. In all truth, I think you should try to get some help from people living in the area or speak to the president. The community gardeners should be sent in and the cost added to his outstanding debt. It’s the only answer and everyone living in your development will benefit. If the house needs any external maintenance , the work should be carried out and costs added yet again to his outstanding debt. The urbanisation solicitor should be writing to the owner advising him that either he gets the house sorted out or the President will and the charge to be paid by him.  I’m surprised squatters haven’t moved in. That’s all you’d want. Nightmare. 

Rats nesting in the garden is your leverage. Demand that this wilderness be cleared fir health and safety reasons.

The President, administrator and family have tried everything. We are awaiting a court case for the outstanding debt but that could take for ever. Nobody under any circumstances are allowed to trespass on his property, volunteers cleared all the garden at one point but had to cut a padlock off the gates to do it, This infuriated him the one and only time he has visited since, we did replace the padlock but to gain access he had to climb over the wall from a neighbours property. Fortunately I had taken photos and showed him how he would never have accessed the property at all had we not cleared it, not possible to get in through either gate, he wouldn’t have got to the front door even over the wall, there was no way in. He did calm down then but when the President went to see him he was extremely abusive and refused to speak to him. He and his family are aware of the pending court case but he is not interested.

We have unkept gardens by us and the grass seeds go into our pool, my husband goes and cuts the ones close to us down.

We don't ask anybody, just do it. As far as I can see nobody can do anything

This is exactly what happens in America.  If you live on an estate and don't do your maintenance, even just cutting the grass, the committee will get someone in to do it and the cost is added to your mortgage.

 Yes indeed they are so strict  in the U.S & not just on gardens. My daughter lived on a sub division in Orlando Fl ( all one storey houses) where even the roof was checked..... if you didnt do sufficient 'maintenance' to your roof you got a letter from the  sub commitee and a set time, to get things done or they would get the work done &  add charges to your  annual fees.  The place was immaculate ha!
