Graag zouden wij een huis kopen,maar het zwembad is niet gelegaliseerd.

Wat raden jullie aan kopen of toch beter van niet?

It is possible in some cases to get legalisation retrospectively and add the swimming pool on deeds, but I would proceed with buying such a property with care. Tell the recent owner to do it, before you proceed with the purchase. There is extra taxation for swimming pool, that may be one of reasons people "forget" to legalise it. Same its quite common with extra outbuildings, garages, house extentions or transformations.

Any work more than 15years old could be classed as antiquity and therefore not be a problem.

Friends of ours selling their house have literally just done this.

The pool was more than 20 years old (they had evidence to prove this) and it cost approx €2000 to get it added to escritura.(Buyers rightly insisted on this being completed prior to purchase)

Wij hadden een kelder die niet was geregistreerd. Hebben we door onze (Spaanse) advocaat laten regelen. Die heeft voor een architect gezorgd die de boel controleert en optekent, en heeft vervolgens gezorgd voor registratie. Zo'n advocaat weet ook of het (nog) nodig is, afhankelijk van wanneer het zwembad is gebouwd. Gestors schijnen dit ook te doen, maar daar hebben we geen ervaring mee.

Is het absoluut nodig? Misschien niet. Maar als het is geregeld heb je er in ieder geval geen zorgen meer over. Ook niet als je het huis eventueel weer wilt verkopen!

Op deze manier hoef je je droomhuis niet aan je voorbij te laten gaan. Veel succes!

Very difficult to say. Normally, if a pool has been there for a number of years, the local council can do nothing about it. (And they usually don't care anyway.)

The time period can vary, but it's usually 8 years.

'Legalization' is something people from outside of Spain worry about.

Spanish people (in general) don't care.

You need to speak with an abogado who works in the area.

Norm.
