Although governed by law the specifics of community fees are for the community itself to decide and vote on and if the rules for the community in question say that late payments will attract a sucharge of 10% then that is pretty much the end of the matter.
You might want to have a read here and in particular note the following:
Be careful to arrange the correct and prompt payment of la comunidad. The Ley de Propiedad Horizontal has fixed that this must be paid within a reasonably short period. Non-payment is taken to court very quickly and is treated as a priority case. If non payment continues, then the court can issue an embargo on your property against payment, and will add all sorts of costs on top!
It's worth remembering that a community should be about more than just the infrastructure, it should be about looking out for each other and helping in times of difficulty or hardship so it's important to talk to the administrator when problems occur.
If you can't pay then worst thing you can do is bury your head in the sand and hope it will go away because it won't.
