Non lucrative visa

Hello 

We are applying for a non lucrative visa through a solicitor and they have advised that we need to give up work before our embassy appointment. We have enough savings to cover the IPREM but obviously would like to work whilst we can, does anyone else have experience of this? 

We are also a non married couple but have a child in common and we are being advised that we both need to show the savings but our impression was that one would be the lead applicant and the others would be dependants. Does anyone have experience of this? 

Sorry for the questions but we don’t know if the solicitor is being over cautious.

If you are applying for the non lucrative visa you will not be allowed to work. All income must come from a reliable source each month. The income requirements are for a single person is around €28000 per annum plus around €6500 for each additional person in the family. You all will need full private healthcare paid for a full year. 

It's not just savings you need to demonstrate that you have an income each year.

If you get caught working with a non lucrative visa it will become void. 

If you want to live and work in Spain you will need to apply for and secure a position first. All available work must be offered to an EU citizen first by law. 

If you are successful in getting work then your prospective employer will need to apply for a work visa on your behalf. 

Firstly decide which visa you require.

I think your solicitor may be correct.

Being not unmarried legally your cohabitee is not your dependent in which case she will have to apply in her own right as you are doing.

Also with a dependent child she will probably need to show 4x IPREM for herself plus 1x IPREM for the child.

I strongly doubt that savings alone will prove sufficient to meet the income requirements and don't forget that it has to be demonstrated for the subsequent 2nd/3rd and 4th/5th year visa renewals.

Hi Richchris2,

I don't believe that proving your employment status is required when applying for an NLV, but certainly the Spanish Consulates are expecting to see P45s when you attend for your application appointment.

With regard to being unmarried, the Spanish government website does not mandate that you are "Pareja de Hecho" (in a legally recognised Civil Partnership) and, in fact, their website even details how you can prove you are in an enduring relationship if unmarried, but I'm afraid the visa officers at the Spanish Consulates in the UK appear to be able to interpret the rules at their own discretion, so it's certainly plausible that your Spanish lawyer is basing his advice on previous (bad) experiences.
