It akll dpends on what your rental contract syas and the reasons you alledge for claiming yeh use of your property. In any case it won't be easy, specially if the tenant could be considered as "in social need" and/or if underage children are living in the property.. You will have to prove that you need the property for your own use, and once vacated you MUST occupy the property yourself or by a family member. You cannot put a FOR RENT sign. This is your situation in an nutshell.

Your lawyer should have told you that the only legally reliable communication is a so called "requerimiento notarial", which the recipient cannot ignore, and constitutes the one and only proof before court for any legal action which is obviously the only way to recover access to your property.. Time is against you, and the legal process can easily take more than 1 year. I live in Murcia and if you plan to visit IKEA we could have acup of coffee and I tell you about my own (disgusting) experiences. PM me if ok..

Sorry to say you're likely fucked and there are several years of courts and expenses in front of you.

Good luck.

Hi, have you tried to negotiate with them? If that doesn't work, you can always try this, although a little drastic...
