Dear homeowners,

We want to share our experience as a cautionary tale for those considering renting out their second homes in Gran Alicante. A few years ago, we entrusted our property to an agent with a rental contract. Initially, everything was smooth, but when the contact ended last March, our daughter, who had secured employment in Spain, was ready to move in.

However, the tenant refused to vacate the property. We patiently gave her time to find alternative accommodation, but she proved difficult to communicate with, leaving us in a bind. In the end we sought legal assistance, but the court case took over a year to process.

We have only been granted access to the property once,last March. We have asked for access recently but have been denied wit silly excuses.

To expedite the process, we redirected our case toward eviction due to non-payment of rent and utility bills,which had been overdue for several months.Shockingly, our tenant, an estate agent from Russia, adeptly navigated the legal systems complexities, prolonging the ordeal.

Our story underscores the need for reforms in Spanish housing laws, as tenants can exploit the systems loopholes. We hope our experience serves as a warning to fellow homeowners, promoting greater awareness of the potential challenges when renting out properties in Gran Alicante.

We wanted to retire this year or next, but are unable to due to ongoing situation with the tenant. Our Spanish dream has become our Spanish nightmare.

Its seems to be a bit of a disgusting habit everywhere nowadays. Unfortunately the landlords suffer financially but the "tenants" think get free accommodation but in long run they never have a safe home or environment because they live life being chased, not good for anyone. 

One thing I was always taught when leaving home, pay rent, no matter what always pay it. Leave on good terms or on best terms possible..

Unfortunately  this problem  is not confined  to  Spain.  Due to the Housing crisis  in many European  countries  and UK.  The  law is more inclined  to side with Tennant  more than Landlords.  It  has happened  on many occasions  in Republic of Ireland 🇮🇪  and we have  has a few TV  Documentary  about this issue. 

But  prior to this problem  causing  Weedy  stress. It  is an age old problem. When  renting  out Property  you  need to be fully  Aware   that  you will be  Swimming  with  Sharks.  Some  People  will always  try to take  advantage  where Money is involved. 

An  old  Saying.  MONEY IS THE ROOTS OF ALL PROBLEMS. 

It is indeed  a Warning  ⚠️   to all  People  who  subscribe  to Buying  a holiday home  in Spain 🇪🇸  to rent  out to help  with costs  of owning  a Home in Spain. Think  long and hard about it 🤔

This is now a worldwide problem, with advantage being given to non-paying tenants/squatters as it helps the governments to NOT have to deal with the problems of lack of housing. Communism/Lefty politics means seizing the property off those who have worked/saved to buy property

Hi Tony,

Although Spain's left wing Government has passed legislation that weights the law in favour of squatters over property owners, it certainly isn't just "Communism/Lefty politics" at fault.  The UK's Renters (Reform) Bill was introduced to Parliament on 17 May this year, whch will fulfil the 2019 Conservative party's manifesto commitment to abolish 'no fault' evictions in England.  And although it's illegal to squat in residential property in the UK, loopholes in the overburdened legal system and circuitous procedures mean that unscrupulous tenants can continue to avoid paying rent to UK private landlords for months and even years.  I certainly agree that governments throughout Europe, including the UK, are abdicating responsibility to private landlords for their failure to provide adequate social housing, but of the 27 EU countries, only 5 are led by left-wing governments.
