First habitation licence

Hi my name is mick ,I would like some advice about a first habitation license .We bought our property off plan from a developer 

named masa 3 years a go on the pretence of renting it out to pay for the mortgage .We have contacted the developers so many times a bout the licence but the keep giving us excuses .Can any body give us advice as to get the licence and then we can applied for the tourist licence.Any help would be appreciated.

I suppose you refer to the "Certificación de final de obra" and "cedula de habitabilidad" which go together. It's the developers legal obligation to supply both together with "boletines" for electrical, water, and gas installations. I wonder why the notary public did not advise you about these. As things are now, you have poor chances to get these documents from Masa for whatever the reasons may be (perhaps the construction was not made to authorized specs). Most probably you will need professional legal help. Sorry to say this but the very same happened to me som years ago..

I agree with the above advice from @killjoy. Our experience with Masa was very poor, I would suggest you get some legal advice and check with Town Hall what they have registered for your build - our experience was that Masa had lodged plans for a completely different building project and so could never get the Habitation Certificate. The other issue we discovered was that they had lodged an outstanding debt against the plot which also significantly delayed the transfer of the plot deeds to ourselves even though we had paid fully for the plot.

I think the only thing you can do is discover the actual situation for your plot and then take whatever steps your lawyer advises to remedy. It's not a good sign that they have not been able to provide the Habitation Certificate to date so expect some issues to arise. Sorry to be the bearer of potential bad news.

Hi Weedy,

Sorry to add to your woes, but I honestly don't understand why people are still buying from Masa.  My sister-in-law has had a terrible experience with them - despite joining a Class Action against them, after 10 years, the lawyers have finally have to admit defeat.  They were a predominant builder during the boom years, prior to 2009, but the build quality has never been good and despite big fines, they have not improved their sales tactics.

I hope you can get the matter resolved.
