Good afternoon everyone, I wonder if anyone is able to offer me some advice regarding our Bungalow on La Marina Phase IV?  We purchased the property off plan some 14 years ago, and although we are not residents, we do use the property regularly and have enjoyed some fabulous quality time and family holidays over the years.  We have kept the property in pristine condition and have repainted the entire outside 4 times in recent years. Last year we repainted the exterior, white, as is stipulated in the rules, but we painted our Ballastrades (which run along the front of the property) cream, along with the ballastrading inside the garden.  We now have a running argument with our 'Presidente' who is telling us we must repaint the ballastrades white, and if we dont, she will employ a decorator to do so and we will be responsible for the invoice.  Can anyone advise if she can do this?  we have consulted with many of our neighbours and no one has a problem with our property, in fact many have said how it always looks beautiful, despite the fact we dont live there.  I would love to hear everyones opinion on this, as I am really digging my heels in over this matter.  I really feel as if I am being victimised over this, as there are many other properties on phase IV who havnt abided by 'the rules' and have coloured, or tiled exterior walls.

Hi Barbara 

A lot here surely depends on what your Community Rules stipulate in respect of these matters.

If I was in your position I would request a full copy of the rules and study them before making any further decisions on it.

As for The Presidente having Authority to access your property to carry out  repainting without your consent, I would strongly and personally challenge him or her all the way  on that one. !

I do hope things are eventually sorted out !

Many thanks LeckyLes, the rules do say 'white boundary walls'.  My argument is, the walls are white, but the ballastrading (which is on top of the wall) is cream.  Also there are many others houses which have painted their boundary walls, cream, grey etc or they have tiled the walls, in grey etc.  There are also properties with black iron railings on top of white walls, these all remain, whilst I am being asked to repaint mine white.

Barbara, you are welcome.

It's something you have to decide upon and ,save for taking Legal advice based on a copy of your Community Rules, I would put all those points in writing to The Presidente with instructions to him that you would seek Legal redress from him if he interferes in any way whatsoever in any part of your property.

And tbh if he came near it whilst I was in Residence I would put the paint pot straight over his head.

That would be assault and a quick trip to the local  guardias nick … !!!!!

Camionpilot, Thank You for the Legal advice, you may be willing to allow it to happen, I am not sure, but If someone trespasses on my property it would be worth it !!!!

If The Local Police did decide to make a case out of it and I was taken to Court to explain my actions with the Paint pot, I would tell the Judge it was all a complete ' Whitewash '  😀😀

Interesting post. It can cut both ways though. We had our view completely taken out by an illegal roof building put on by our neighbours and despite complaining to our president and filing a denuncia at the Town Hall have achieved nothing. Not even the courtesy of a reply. So I would stick to your current paint Job. They still haven't even filed for retrospective permission.

I have recently moved into phase 4 and have emailed the administrator twice for information on what I can or cannot do I've waited over 8 weeks for a reply so I have now employed a builder to start work very soon 

I have no information on any president what I am paying for what I can do and as their are so many different things that have been done to the houses I would assume you can do as you want to a certain degree

Leave them cream that's nearly white
