Has anyone actually been prosecuted for over staying ?

Just wondering how strictly the rules are being applied, especially in the circumstances of the OP where the over stay period is a few days .

As a retired UK immigration officer who worked in France and Belgium, working very closely there countries border forces, I can tell you that I have seen people fined and also refused admission, for overstaying in the Schengen zone. It is something they take very seriously.

Good question

Simple answer Yes I have seen fines issued and people refused entry, to the Schengen zone

Thank you all for the advice. I've now booked new flights to make sure we don't overstay

Just to muddy the waters while on your stay you became I’ll Covid related meaning you couldn’t fly what happens then ?

From the Schengen website:

---------------------------

There are also cases when people do not bear any consequence for overstaying their visas. If you are a child or a person that cannot travel without a caretaker because of an illness or disability, then most possibly you will not face any consequences for overstaying.

On the other hand, if you face an accident or unforeseen illness, or you are in a situation that does not permit you to travel to your home country, then you are strongly advised to apply for a Schengen visa extension instead of overstaying.

We have been out for 4/5 day breaks since the 90 day malarky kicked in.  Twice now, we have flown back through Alicante & not had our passport stamped out, {had it stamped in a week earlier}  due to our departure gate being the wrong side of passport control. we have been since & been stamped in & out, so where are the days logged / checked.

The Spanish tourism needs us holiday home owners to prop up the tourism economy {as we have done for many years} so who & when will they wake up ?

In the bigger picture the difference between 'swallows' staying for 3 months instead of 6 -  or more - will be all but immeasurable and certainly not enough to prompt any change in the rules.

Not sure if the immigration are that bothered, with the state of the Spanish economy every day that non residents are in Spain they are spending money which is richly welcomed ,After the mass evacuations of the Brits after Brexit the Valencia’s Council we’re pushing to try for a 4 months stay for non residents which was then being talked about 6 months. It certainly needs something to push the economy because where we are at the Blue Lagoon it’s like a ghost town.Maybe some of you out there can verify something I read on a Spanish website that if you over stay you are classed as a resident and come under Spanish tax, maybe someone knows to help if this is true?

Not sure about classed as resident, haven’t heard that.
I take it you are campaigning for all 3rd country nationals to be given the same rights, or is it just the British who left the club, but still want the benefits.

We have South African, American and Mexican holiday home owners around us, so would you campaign for them to be able to stay for longer than 90 days, or is it just for Brits
