Hi there, hope you are all enjoying the summer....

My sisters and I have had an offer on my daddy’s apartment that he left us as part of an inheritance...

The offer was 44000€ .... to be split 3 ways.

The estate agent has charged 6000€ inc VAT...which seem a lot... but due to family complexities .... the choice had limits.

There is also around 2000€ in a BBVA bank account....

I’ve been told there are new capital gains taxes..... does anyone know if I will pay on this amount please?

People on here can give opinions but you need proper and accurate advice, so please go to a professional.  You need an independent solicitor (abogado) to ensure all the necessary paperwork is completed and all taxes due are correctly paid.  There are also a few solicitors in the UK qualified in Spanish law but they will be a lot more expensive than using one in Spain.  Without knowing your Dad's apartment details no one can say if the offer is good/bad.

I used Abaco Advisors in Torreviega when I purchased my property earlier this year.  They also arranged our Spanish wills and will be handling our future tax.  They seem to be a biggish firm with specialists in various fields but we always dealt with English staff who passed on our queries and their responses quickly and efficiently.

Highly recommend them and have seen others recommend them too on this forum

She can keep her account here for as long as she likes, but it will of course be subject to bank fees, so it's best to close it as soon as any costs associated with the sale have been settled. It won't be necessary to keep it open in order to pay non-resident tax, as that can be paid from the UK.
