If some alteration was done illegally then getting a habitation certificate becomes a problem it should only take a max week to get one ,be very care full do not sign without one there are loads of property on the market that are legal

The thing is nothing has been done to the property , it’s the original build of 30 years ago , no extensions nothing that’s why I’m very concerned ?

Maybe it was not legal in the first place have you seen the old certificate ask to see a copy of it and remember never trust anybody on the word number one estate agents

I was told that this certificate is on going,the 10 year limit is just a number which is quite common language in Spain.I certainly have not had a problem since it was brought in.It's just another bit of paper which didn't exist until a few years ago.I have sold many properties here in Spain including a business.I have no concern that I shall sell my property at present on the market in the same way.Most of the problems that British buyers encounter have to be involved with old Spanish homes which have multiple names on the"escritura" which is because of the Spanish inheritance laws.My granddaughter is Spanish,born here with English Mother,Spanish Papa.She will be in line for everything passed down from all her property owning relatives unlike our English inheritance laws.This is not likely to come up if you are buying a recently built property from a northern european owner & not in a rural location anyway.Having owned & sold both businesses & homes in various areas of both Scotland & England before coming here & selling them successfully,I find it odd that this has proved to be a problem in a much simpler system.

Hand in there, there are always obstacle to overcome ,but will be worth it in the end.  We are moving from New Zealand in October.  We have bought and completion date is end of September.  Heaps for us to do, along with other documents needed from the Solicitor we weren't prepared for.  But we know once we are there, it will be worth the effort.  We are moving to the Orihuela Costa.

We moved here 5 years ago and that was stressful our buyer pulled out the day before we exchanged contacts and it took us 6 months to get another buyer in the meantime we had signed a contract for rental and lost 6 months rent , but we are here now and love it please don’t be put off it’s a great life x

I have a dual passport.  NZ and EU, my hug and has NZ only so no problem moving there permanently.  But still a lot of beurocratic  hoops to get through.

Hi - update - still in UK!

The exchange contracts and completion dates were still being discussed when we had to decide whether or not to send our cat without us knowing when or if we would get there or not... !

So as we were haemorrhaging money for 2 houses - rental sprain/mortgage here we have decided to wait until the contracts are exchanged here - rent here for a few months to try and recoup some of the losses we have incurred.  Plus with all the stress here we didn't think we had it in us to go through it straight away in Spain to get papers etc sorted there.  Plus other costs increased over there eg car hire as it's now summer, until we get sorted to buy one (I had a good quote for May but!!).

So sadly I wont be in Spain this year I don't think (unless Mr Lottery looks kindly on me!).  

We knew house selling was stressful when we decided to sell and that it wouldn't be easy going to a new country but you really couldn't make up what has happened in a 3 way chain, and still goes on!  Thank god we had a good solicitor who stopped us putting more money into deposits for various services as she said don't as the conveyancing from our buyers (an online one they used) and their buyers were appalling.

I will get there but slightly delayed - I've cried buckets but now putting that into positive energy to get back on track, move hopefully end August(?) and plan again!

So I wont be drinking my body weight in Cava quite yet!!

Onwards and upwards!

Thanks for the update Rosy. Sorry to hear it hasn't worked out as planned - yet.

We had a similar situation in UK a few years back, we sold our house and the day we were to move, the chain broke with our buyers not being able to move as their buyers puled out at last minute. It makes you wonder why we pay solicitors and conveyancing fees , when they can't prevent any of this from happening?

Anyway, we stayed put for 6 months and then sold again , without issues and made and extra 10k- so all worked out well and, thinking back, you tend to forget the hassle and just remember the laughs and the absurtity of it all.
