We were the same as you. We thought it would never happen. You must try to work together as a team when things get tough. We found giving each other a big hug helped plus it’s your dream guys don’t give up. We have only been in our house 2 weeks. We started in October last year.

Pickfords is hardly a small local firm ?

Does anyone know the law about waiting times, I have asked this before (sorry) but really am tearing my hair out now, deposit of intention to buy paid on the 28th March, everything has taken a while because of getting POA, but the hold up for the last 8 weeks is the certificate from the town hall , the ‘cedulla e habitabilidad’ , my solicitor says he is chasing up the vendors solicitor but when I asked how long am I supposed to wait there is no answer, just it’s the town halls fault. I refused to sign the sales contract because this was what I had read was the correct thing to do before the certificate was in. They suggested the the solicitor holds a retainer back but the venders would not agree to that. So I’m just stuck waiting, any more advise, and I only have a receipt for the deposit money , not any type of contract.

Give the other side 7 days and pull out if no contract has been signed you should get your deposit back you must have this certificate before you sign . I got a new one recently as only last 10years took 3 days

When I sold a previous property about 2 years ago this certificate was obtained via the agent handling the sale.I recently have put up for sale another property & asked the agent who sees that this is in order.I was told that they would(again) arrange this but it is quite straight forward if the seller is occupying the property as the utilities are obviously being accessed.If you want to buy this property perhaps you should approach the selling agent directly as they must have obviously been in contact with you throughout.Don't go off in the huff because this sort of thing could come up again with a future buy.Believe me,having been here for 30+ years you should forget how you would approach this if you were in UK,this is Spain.One time in my business there was a British Kennels owner who came here to pick up a clients dog for onward transport into UK quarantine.They told the Ministry man to"Get off his rear end"!  He walked out & they had to come to our Kennels to sort it out.The pet was successfully on the way once a few feathers were unruffled.I believe Pacoboy that you have said you are on your way back to UK,so perhaps this way of life is really not to your style.

Correct . But habitation cert should only take a few days there is something not right about this property I would walk away.

Thank you , when I have been in touch with the agent she just says take it up with the solicitors , it’s not there fault but the town halls fault even after 8 weeks , can’t get a straight answere of if anyone , even when I asked the solicitor about my legal rights and how much longer am I expected to wait he just says it’s down to the venders and there solicitor . I didn’t want to loose this property but this is really getting me down now . Thank you for your answers
