Hi

I wonder if any one knows, I have residentia and my husband was travelling back and forward before all this Covid.   I know to get back i to the country you need to be a resident or have other proof. I was wondering what rights my husband would have   If there are any spousal rights etc?   Thanks in advance.

Hello,

Afraid he has no rights without residencia...everyone has to apply independently , you cannot benefit from someone elses card/certificate......TIE cards have photographs & fingerprints on. As you said, at the moment only people showing resdencia, + people who have official  proof of application & spanish passport holders can enter Spain

Cheers

Once he has got back into Spain he needs to apply for residency.

Were you both living here before the Brexit deadline? If so, he might be able to apply using the pre Brexit requirements on income and healthcare and the fact that his spouse is a legal resident (assuming that you are)

None at all I’m afraid.

Hi Nicky,

You're correct, without residency your husband is unable, currently, to gain entry to Spain.  Hopefully, that will change in May or June.

You don't say how long you have had residency, so there may be a possibility for your husband to apply for residency as a family member of an EU citizen:

Kind regards,

Kim
