Hi all

Neither  my partner or myself are yet at the British state retirement age even though we are over 60. If we were to buy a property this year before the December Brext deadline, could we apply for residencywhilst still both living the majority of the time in U.K. and working in the UK maininly using the property for holidays for the next 18 months at least.  Would this give us the rights that they are saying would transition to those already in Spain and holding a residency card or we unable to hold a residency card if the UK is our main residence.

I think you need to live in Spain for a total of 182days in a year to qualify for a residency. There's other requirements, like monthly income etc.....but yeah, it's 182days you need to be living here in a year to qualify....

Don't do it.

You can't apply legally for a residency certificate unless you live here. Whilst the movements of UK citizens aren't monitored, it would be possible to get away with it, but there have already been comments that movements to record length of stay have started to be monitored, and they certainly will be after the end of this year.

Just be aware that if you did declare yourselves resident, you'd then be fiscally resident for 2021, and would have to pay resident tax here.

On top of that, you'd have to pay for one year's private health insurance in order to be granted a residency certificate.
