Hi, we have an apartment in Playa Flamenca & each year my daughter & her family & then my son & his family like to spend a couple of weeks holiday at the apartment (we do not go with them). My daughter has the first 2 weeks of August & my son has the last 2 weeks of August, no money changes hands as they are family. I have read that we need to apply for Registro de Turismo as since Brexit this is a requirement for non-EU citizens. Border force in Spain may ask to see proof that my family have a legitimate place to stay. Does anyone know where we can apply for this please? Thanks in advance

If you aren't offering it for rent you don't need a tourist licence. There is no requirement for friends and family who do not require a visa to get an invitation letter.

Both these subjects have been discussed many times over the last week or so on here.

Thank you for your reply. I've not been on the forum for a while so haven't seen this subject mentioned before. I saw something yesterday in an online newspaper so decided to investigate as my family have booked their trips & I didn't want them to be refused entry.

This comes under the "things we say but don't do" scenario.

To enter Spain you "could" be asked to show proof of accommodation, you "could" be asked to show the financial requirement of 90 euro per person per day, you "could" be asked for proof of onward travel within 90 days. Nobody has been asked for these things nor have they been asked for in UK where the requirements are the same (except within 6 months).

But a tourist registration certificate will only be issued once you have permission from the community, show your property meets the minimum requirements with a compatibility report (costing about 100 euro)  for facilities, is registered and you have a licence number (cost about 60 to 80 euro) and that has been taking over a year so hardly going to work for your visitors in August.

You then need to register your guests with the Guardia Civil with all their details and, as you now have a licence, charge them the tourist tax (which is going to be binned shortly) and submit a tax return every 3 months even if you haven't received any rent.

No money is changing hands therefore you don't need a Tourist License for holiday letting as you are not renting out the property, they are using it for free.  You cannot register them as guests because you don't have a license, neither do you need to register them.

Thank you.  That has put my mind at rest, it's a bit of a minefield with all the Chinese whispers going around. My family love the apartment and I am glad that they can still use it.

Once again, thank you for your reply. Sounds like a bit of scaremongering by the press. We bought the apartment so that we & the family could have holidays so as you say, I will let sleeping dogs lie.

Whilst the "Carta de Invitación" is required for Third Country Nationals (including the UK) for travel to Spain, the EU granted UK citizens visa-free travel post-Brexit, so UK travellers are highly unlikelly to be asked for it - unless Border Control has a marker against someone for criminal activity or their attention is drawn by suspicious behaviour.
