Good afternoon all,and thanks to everyone in Spain for providing us Spanish hopefuls with some very useful information.

We are applying for our NLV,s from the Manchester consulate, and I was wondering if anyone has obtained their medical records from elsewhere besides their own doctors,as I believe the doctor has to be registered with the FCDO and if they aren’t the application is delayed or worse,rejected....

...

Yes this correct. Our GP signed it but they rejected it as she wasn't on their list. It took another few weeks to sort it out. The Apostille service said they apply again every 7 days so the GP can give their signature so they can cross check it. A bit worrying that the GP can sign things when they are not sure what it's for, but there we go. We had our appointment on the 7th of Oct, but haven't heard anything yet.

Hi, have experienced this, the FCO have to verify the GP signature, they have a database, if GP is not on it they then contact the GP, as you said and we know, takes ages. A shortcut to this is to ask the GP to verify their signature in advance, when you apply for medical, there is a section on the FCO for this. Hope this helps, we also are waiting on Visa, interview was 24th Sept, been a long road.

Hi Shaunagh,

This is news to me.  Having obtained a Non Lucrative Visa, the second part of the process is to move to Spain and apply for the TIE (Tarjeta de Identidad de Extranjero).  The terms of the TIE are that you must live in Spain for a minimum of 183 days (i.e. 6 months + 1 day) per year, for...

... the first 5 years - if you are outside of Spain for longer than 6 months in any of those 5 years, your residency is no longer valid.

I've checked the Spanish Consulate website and can't find a reference to '10 months maximum absence in 5 years'.  That doesn't mean it's not there - I just can't find it! 😄 - so it would be useful if you could ask your lawyer where to find it on an official website.

Kind regards,

Kim

Hello from we newbies, please be gentle with us; am I missing something obvious (I often do!), re the conversation about 10 months over 5 years, may I wonder why, if one chooses to live in Spain with a NLV, one would actually be absent for that long? We plan, hopefully, to spend 9 to 10 months in Spain, popping back to Blighty just for July & August. My arthritis and Fibromyalgia, agree.. :) 😀😃

Thanks very much for your replies, your confirming what I thought. I’ve also read that you can go to a private medical practice who is recognised by the FCDO,and who will be able to access your records, and pay for their services. I know it would be more expensive, but if it takes away any uncertainty it would be worth it.

Hi carjelk60 and welcome to the forum!

I hadn't heard of the "10 months in 5 years" possibility either and was hoping that Shaunagh's lawyer would advise her where that's detailed on the Spanish government website.  Nevertheless, I don't know why anyone would choose to be absent for a protracted period either, unless if it's on compassionate grounds perhaps, such as caring for an elderly relative in your home country 🤔

Kind regards,

Kim

Hi, I have  reached out to my lawyer and requested clarification of this requirement ie a copy of the legislation or to point us to where we can find it.  I understood the absence rule was rigid and if you failed to meet  this you would not be deemed a full resident. I don’t know what the consequences would be. Re my absences, I have no intention of being out of Spain too often, but I am worried that an emergency could happen in the U.K.  and my daughter may need me. My lawyer never mentioned any exceptions to the rule. Hopefully she will clarify tomorrow.

Hi Sue and Alfie, just to say we’ve just been through our appointments at Edinburgh and they DO keep your passport. We had to leave a SAE envelope for each passport. They wouldn’t put 2 in one envelope. So I guess it depends on which consul you have to go to !

Hi. You’re the only people I have found that went to Edinburgh consulate. On their guidance page it says 12 months bank statements and P45. I can’t leave my job until I know my NLV is successful. Any help you can give me regarding the Edinburgh consulate being very different, if it is, would be really appreciated. TIA. Chris.

Hi Chrisnpaul,  if you are to be resident in spain then you wouldn’t have a job with an NLV visa, so you’d have to show the required income by means of savings, property deeds pension income etc. Unless you are able to continue to work your UK job in Spain then you would just show evidence of your salary and evidence that you are able to continue working for the company.  The NLV is a non working visa.

Ah we have done ten years of elderly parent caring, they are all now passed and at peace. Hopefully this move at last will be our time. :)
