Hi Naomi
I can’t help with the area local to Sax as we live in Orihuela Costa, we are however currently going through the residency process with my wife having an EU passport and myself U.K. TIE issued last week for my wife.
As the clock has started on your 90 days, you’ll need to be proactive in order to have the documentation available for your husband to get his residency first, once his has been issued, you can then apply off his TIE.
Off the top of my head you will need to have (this is what was requested for us, not everyone may be asked for the same things)
6 months of bank statements from U.K, showing account numbers, names, address and stamped by the bank. These will need to be translated.
6 months Spanish bank statements, same as above.
Any pension statements that you may have such as HM Forces, Civil Service, to show that you can support yourself.
Private healthcare from a Spanish provider. We used ASSSA, as with all things people have differing opions on which companies provide best value for money. We are in our mid fifties and it cost just under €1800 for both of us.
Register on the Padron in your area. You are allowed to do this as you are applying for residency. (You will need passports, rental agreements or copy of deeds along with a utility bill showing your address.
You will need a copy of your marriage certificate. https://www.gov.uk/order-copy-birth-death-marriage-certificate It must be no longer than 3 months old when presented. We payed for the express service and had the certificate in 48 hours.
That’s the easy bit, next the marriage certificate must be aposilled. Two ways to do this, first via an agent as mentioned on the website below, they can do it much quicker, however be prepared to pay hundreds of pounds for this service. Second, is to do it yourself through the link. We did it ourselves, downside to it is that it took over 4 weeks to be processed. You can get an email update that gives you the current processing time at the moment it’s around 25 working days. The document were returned to us in Spain via DHL. https://www.gov.uk/get-document-legalised.
To save time have the marriage certificate sent straight to the Legalisation Office. You can start process with the Legalisation Office before you have requested the marriage certificate and use the address given during the application. Hope that makes sense, it’s a bit of “horse before the cart”.
It’s all achievable, just a bit of planning and have a competent translator to assist you. I can recommend the lady that we have used. PM me for details if required or if you have any other questions.
Again, I’m sure there will be lots of different takes on what you need to achieve residency but this has so far worked for us.
Cheers
Paul
