Hi folks

We are in a bit of a dilemma. We came to Spain on the 16th Oct 2020. We came here looking to buy a property. But now we find ourselves not knowing what to do. Our 90 days stay is up at the end of March. But unfortunately we are living in our caravan at the moment, until our house was purchased. So.... we have nowhere to go home too. 

Would the Spanish make any exceptions about staying over due to this situation??

To be on the safe side report to the police and explaining your situation  ask for a "permanencia".

Hi Lesley,

If you want to stay in Spain, you need to apply for residency asap.  To do this with the protection of the Brexit Withdrawal Agreement, you need to prove that you were living permanently in Spain before 31 December 2020.  This usually requires the production of property Deeds or a long term rental contract.  I've never heard of someone using their caravan as an acceptable home address, but if you can prove that you're in the process of buying a property (e.g. have you paid a legally binding deposit?), then this may be acceptable.  It would certainly be in your interests to apply on this basis, rather than as a Third Country National, but I think you need to speak to a gestor to establish your likelihood of success.
