If you have made a claim to your insurance company, within the time limit normally stated in your policy, and they refuse to cover the damage, you need to check your policy and  consider making a complaint. 

Next step - if complaint does not get you anywhere, may be a lawyer, but at that point cost benefit has to be considered.

It used to be straight forward rules, your insurance company pay you, and have a regress claim towards the other party which were your insurance business to fight for. However this is no longer so. Wish it were though.

Absolutely contact your own insurers …take copious photos of damage …keep any repair receipts …I’ve had this done to me as well

And today water started coming down from my bathroom roof as well. Will be a test of my insurance company's (Caser/Sun bay) reliability this. Never had any claims before.

Contacted them immediately after I discovered the leak, also notified the administration and the upstairs neighbour. Crossing fingers everything will work out well.

Bad luck indeed!

They already sent me a message that a plumber will come tomorrow afternoon. Obviously they are lessed stressed then I am 😁 That is about 24 hours after the leakage started, and the paint is already becoming bubbly, and a crack is forming on the roof.  I must admit I am a bit stressed and worried. But, it is good they have promised a plumber for tomorrow.

Knowing Spain, I hold my fingers crossed that the plumber will actually be here.

Edit: Obviously I also contacted the people who live above me. They got stressed too.

Were your upstairs neighbours in residence ? Was no one available to turn their water supply off ?

Well, my insurance is now involved, my neighbor is engaged , and someone is coming to look at the damage within 24 hrs. 
this is my second flood from a neighbor. The first time was from the fifth floor, which went down to the fourth, third second and even first. The gentleman who owned that apartment fixed all the apartments very very quickly. This time I was flooded from the people above me.  When we leave our apartment to go home we always turn the water off and drain the faucets.

Been a busy day today. The plumber arrived within schedule. He seemed to know what he was doing. He concluded the leak originated from the top floor, hence not a problem for my insurance company. As far as they are conserned problem solved.

The plumber will according to himself and the insurance send a report to the administration. I asked for a copy  Whether I will get one, time will show.

The responsible party is of course now the challenge. According to plumber and insurance he (top floor owner) is obligated to close his water off at the meter. The plumber did so, but the owner opened it up again. 

Water is still coming through my ceiling, the plumber also had to cut in to the ceiling; and the  residual current switch tripped, so now I have limited electricity and no fixed light. Wirering in the ceiling is fried. This in addition to rain inside. Gallow humour is a helpful tool.

I have updated the administration/secretary who is acting on behalf of "el presidente" verbally, and by e-mail. Always good to gather documentation.

Next step is to follow up with the administration, check that they receive the insurance report, and that they follow up on this.  Also ask everyone I can think of in the community for support. Already let the neighbour in to view the sorry sight.

Hopefully this will be rapidly solved, without to much agony, albeit not holding my breathe. Better be happily surprised.  When Spaniards says it will soon be solved, in my experience it either happens really fast or is indefinitely postponed 😁

After all, I am the one with the problem. Upstairs have no water on their floors. Hopefully their water bill will scare them in to action. 😁

My apartment smells like wet plaster now.

You have my sympathy. Right now we are rowing similar boats  I follow your case with interest. 

As far as I understand the system, even though your insurance may not cover the damage, their report is used by "el presidente"/administration towards the eligible party.

I cheer for you, and hope you do the same for me, albeit my case is fresh.
